bo recovered in the name of said company, by an
action of debt before any Justice of the Peace or
in the Circuit Court of the county in which such
damages shall be sustained, and also be subject to
an indictment in the Circuit Court for the county
where such offences may be committed, and upon
conviction of such offence, shall bo punished by
fine and imprisonment at the discretion of the
Court. |

Sec. 23. And be it enacted. That the said com-
pany shall have the right to construct a line or
lines of wires of telegraph on any routes over
which, by their charter they have the right to
construct a. Railroad, and for that purpose shall
be entitled to the benefit of all the provisions con-
tained in the twenty-sixth Article of the Code of
Public General Laws, from section one hundred
and two, to section one hundred and twenty-one
inclusive, or so much of said provisions as may
be applicable thereto. |

Sec. 24. And be it enacted, That should the road
or roads not; be commenced within three years from
the passage of this Act, and not be finished with-
in five years thereafter, then this Act shall be null
and void. |
