the said owner or owners, his, her or their legal
representatives.


Sec. 15. And be it enacted, That whenever in
the construction of said Road or Roads it shall be
necessary to cross or intersect any established road
or way, either public or private, it shall be the
duty of said President and Directors of the said
company so to construct the said Railroad across
such established road or way, as not to impede
the passage or transportation of persons or proper-
ty along the same, or when it shall be necessary
to pass through the lands of any individual, it
shall be their duty to provide for such individuals
proper wagon ways across said road or roads
from one part of his land to the other, and when-
ever any road or roads may hereafter be authori-
zed to be made by the Legislature, where it may
be necessary to cross said Railroad, the company
shall make or cause to be made, a proper and con-
venient way for said road to cross.

Sec. 16. And be it enacted. That the Elkton and
Delaware Junction Railroad, with its lateral ways,
shall be deemed, and is hereby declared a public
highway, subject to the imposition of tolls to be
hereafter regulated by the Act.

Sec. 17. And be it enacted, That said company
shall start and run their cars for the transportation
of passengers and property, at regular times to be
fixed by public notice, and shall furnish sufficient
accommodations for the transportation of all such
passengers and property as shall within a reason-
able time previous thereto, be offered for transpor-
tation at the place of starting and at all such stop-
ping places established for receiving and discharg-
ing way passengers and freight for that train, and
shall take, transport and discharge such passen-
gers and property at, from, and to such places,
on the due payment of the freight or fare legally
authorized therefor, and shall be liable to the par-
ty aggrieved in an action for damages for any ne-
glect or refusal in the premises.

pletion of the said Railroad or any section thereof
