the same from time to time to repair, renew or re-


move; provided, always, that the said Company
shall not in any manner injure or displace any of
the pipes laid or to be laid for the purpose of sup-
plying water to said city or any of the pipes then
or thereafter laid by the Gas Light Company of
Baltimore, and provided also, that the Company
hereby incorporated, shall immediately after lay-
ing, repairing or removing any pipe as aforesaid
and always within two days after being thereto
required by Mayor or city Commissioners, cause to
be filled up repaired and repaved at the expense of
said Company every such street or a part of a
street, square, lane or alley as the Company may
find it necessary to dig, impave or unpave for the
purpose of laying, altering, repairing, renewing or
removing any pipe or pipes as aforesaid, and if the
said Company shall he guilty of neglect in the
premises for the space of forty-eight hours after
being notified as aforesaid by the Mayor or city
Commissioners, the said Company shall for every
such neglect, forfeit and pay to the use of the city
such sum not exceeding twenty dollars as any Jus-
tice of the Peace for said city, shall adjudge on a
warrant to be issued in the name of the Mayor and
the City Council of Baltimore against the Presi-
dent and Directors of the said Company, and also
the sum of five dollars to be recorded as aforesaid
for every day they shall neglect or refuse so to do
after issuing of the first warrant before mentioned
for the recovery of the said penalty of twenty dol-
lars.

Provisos.

Sec. 9. And be it enacted, That the Company
when duly organized as hereinbefore provided,
shall be entitled to and may have, hold and exer-
cise all the rights and privileges granted to the
Gas Light Company of Baltimore, by the second,
third, fourth and fifth Sections of the ordinances
of the Mayor and City Council of Baltimore, enti-
tled an ordinance to provide for more effectually
lighting the streets, squares, lanes and alleys of
the City of Baltimore, approved June seventeenth,
eighteen hundred and sixteen, and the Act of As-
sembly of December Session, eighteen hundred and
sixteen, Chapter two hundred and fifty-one, so far
as the same are not inconsistent with the provi-
sions of this Act, and the said Company hereby
