done, and materials found, and shall cause the
city Commissioner to ascertain the proportion of
expense chargeable to each proprietor, and may
recover the same by action in the Circuit Court or
before a Justice of the Peace, according to the
amount awarded, or may distrain the personal
property of such proprietor at any time within six
months from the time when the ascertainment of
the proportion of such proprietor shall be made by

the City Commissioner, provided, at least ten days
notice be given by the Mayor of said city to the
said proprietor of the amount of his or her assess-
ment, prior to such suit or distress; and the said
corporation are hereby vested with full power to
pass all ordinances necessary to carry this section
into effect.

Coal Weigh-
er to be ap-
pointed.

158. That the Mayor, Aldermen and Common
Council of Frederick, at the usual time of making
appointments, shall appoint a Coal Weigher for
the city of Frederick, and shall have power to
pass all ordinances necessary and proper, to pre-
scribe and define his duties, the amount of his
compensation, and to punish all violations of ord-
inances passed under the provisions of this sec-
tion.

Fines to be
imposed.

159. That in cases in winch any person or per-
sons shall befound guilty of violating any ordin-
ance of the corporation of Frederick, it shall
and may be lawful for the Mayor or any Justice
of the Peace, trying said cause, upon the convic-
tion of the offender, to impose the fine prescribed
by the particular ordinance under which said per-
son or persons is or are tried, and upon failure or
refusal of the party convict thereof to pay such
fine and costs, to commit the person or persons
convict, to the Jail of Frederick county for the
time prescribed by the said ordinance, unless the
person convicted shall pay such fine and costs be-
fore the day limited in such commitment, in which
case the Mayor or Justice of the Peace shall issue
his order to the Sheriff to release said person or
persons.

Relating to
minors.

160, That the Mayor, Aldermen and Common
Council of Frederick, shall have full power and au-
thority to pass all ordinances necessary and prop-
er to provent, restrain and prohibit all minors
