A. The book of the fifth election district, purporting to be
the book of Registration of that district, was filed on the 6th
of October, 1865, by one of the .registers—I can't say, now,
which one.

A. It was not.
4th.
A. That It was not.: the book purporting to be the book of
Registration of district No, 12, (Smith's Island,) and the
list of qualified voters for said district, were not filed in the
clerk's office on or before the 7th of November last, but were
filed on the 9th of November, 1865; my recollection is they
were filed by Mr. David Tyler, one of the officers of Regis-
tration of that district; I don't know, but my impression is,
the body or list of names is in Mr. Littleton Long's, Jr..
handwriting; the certificate, I believe, is in Mr. Isaac Gib-
bond's handwriting, except the last five wordy, which I think
are in Mr. Long's handvwriting; this is all speculation—I
didn't see any of it written; the signatures I am not ac-
quainted with, except Mr. Tyler's, which I think is his; the
signature of Mr. Byrd, clerk, I think is in the handwriting
of Mr. Littleton Long, Jr.; I have no reason to believe this,
except from my general knowledge of the handwriting of
those gentlemen, (Mr. Tyier, Mr. Long, and Mr. Gibbons;)
I have no knowledge of the handwriting of Harry Bradshaw
and William Evans of John.
Cross-Eximination :
Was there such a list as was enquired of and spoken of in
your answer to the third interrogatory filed in your office ;
and if so, when and by whom?
(This question and answer objected to by Claimant.)
A. The list enquired for was filed on the 26th day of De~
cember, 1865, by Mr. James W. Hayman, one of the officers
of registration of the fifth district,
2d. Does not the certificate and names of qualified voters.
on the list you have spoken of appear to be in the same hand-
writing; I mean the list spoken of by you in your answer to
the fourth interrogatory?
A. I think not.
3d. Do you know the handwriting of R. F. Byrd?
A . I do not; nor do I know the man.
4th. Is not the mime of R. F. Byrd, Clerk, signed to the
paper ?
