Somerset County Ss. / Smith agt Holland (76)
Michaell: Holland was attached to answer unto Capt Henry Smith, in a plea that he render unto
him his reasonable account which to him he ought to render. And whereupon the said Henry by
Peter Dent his Attorney saith that the said Michael the 14th. day of July in the yeare of our Lord
1689 had received of the moneys of him the said Henry the sum of two hundred and nineteen pounds
three shillings and two pence sterling, and the sd Michael. the sd Sum of money having recd the same
to
his owne propper use did convert and dispose to the damage of the said Henry of five hundred pounds
Sterling and there of he bringeth his suit. Dent. Pledger John. Doe

Michael Holland was attached to answer unto Capt Henry Smith of a plea of trespass upon ye Case &c.
And whereupon the sd Henry by Peter Dent his Attorney, saith that the sd Michaell the 14th. day of
August in the yeare of our Lord 1689. the said Michael was indebted to him the sd Henry in the
Sum of fourty pounds three shillings and three pence for Severall Sums of money of his the
said Henrys by him the sd Michael recd, and the sd Michael being So indebted did assume upon
him Selfe, and to the said Henry promise that he the sd Michael. the sd Sum when requested. would
content and pay. Never theless the sd Michaell the said Sum of money hath not paid although often
demanded but hath hitherto denyed doth still deny to the damage of the sd Henry of two hundred
pounds Sterling and thereof he brings his suit. &c.

Holland agt Smith
Somerset. County Ssc. Capt Henry Smith of this County Gent was Attached to answer unto Michael
Holland of the same County Marryner in an action of the Case. ----------------- And whereupon
the plt by his Attorney James: Sangster Comes and Sayes that the defendt. Capt. Henry Smith
in the month of January the yeare of our Lord 1688/9 the 18th. day did Shipp a board his vessell y
as Mate of the said vessell, where the plt did agree to and with the deft for seven hundred pounds
of tobacco per month as Mates wages, the plt did remain at worke as Mate for two months -
which did amount to fourteen hundred pounds of tobacco, of which the plt was to receive one half
paid in Barbados (which the plt received) and the other halfe in tobacco: now about the eighteenth
of March following the defendt did agree wt the plt to goe Master of the said Shipp Vessell at one
thousand pounds of tobacco per month where the plt did remain Master Six months and two days
which amounts in all due for Mates wages and Masters Six thousand seven hundred pounds of
tobacco, which said wages the sd defendt did faithfully Assume and promise to pay the plt but the
said defendt fraudulently and craftily intending to deceive the plt. of his sd wages hath hitherto
denyed payment and yett doth deny though often thereunto required in the plts great loss and
damage to the value of Thirteen thousand four hundred pounds of tobacco and here upon brings
this suite. John: Doe

Somerset County Ssc. Capt. Henry Smith of this County Gent. was Attached to answer unto Michael: Holland
in a plea that he render two thousand five hundred.lb. tobacco which to the plt he oweth & unjustly deteineth &c.
And whereupon the plt by James Sangster his Attorney Comes and sayed that in the month of September

last past the plt did deliver unto the defendt. one man Servant named John: Hamleton Senior wth instructions
to sell the said Servant for the sum of sixteen hundred hundred pounds of porke; if he could gett the
porke, if not to sell him for two thousand five hundred pounds of tobacco, now the plt saith that
the sd defendant hath disposed of the sd servant for the sd sum of tobacco, but graudulently and
Craftily intending to deceive the plt, refuseth to deliver either the servant of the said Sum
