Millman and Berrys tryall was this day (125) June 14th. 1690: this day Comrs as afore. viz mr. Francis Jenkins: Mr. James = Round. Mr Samuel: Hopkins. Mr. Thomas: Newbold. Mr. Edmund: Howard Mr. George Layfield. -------- - - - - - - - - - - This Bill bindeth me Thomas: Millman me my Heirs or Admrs to pay or cause to be pd unto James Berry his Heirs Execcutors or Admrs the full and just sum of twelve hundred and fifty pounds of good sound merchbl. tobacco upon the tenth day of November next ensuing the date hereof in Some Convenient place in Somerset County, as wittness my hand and seal, this 9th .day of ffeby 1687 his marke a Testes Eliz. Wee the Jurors having rightly Stated the accompts of the plt. and deft. according to our Evidence we find ye balance to be seven hundred pounds of tobacco due to the defendt, with Cost of suite William: Coulborne. formn Edmund: Beauchamp. Plt. Somersett County Ss // John: Rousilla of this County Chyrurgeon was sumd agt to answer unto Edmund Beauchamp of the same County Clk. in a plea of John: Rousella Deft. trespass upon the Case. ----- And whereupon the plt by James Sangster his Attorney Comes and sayes, that the defendt is and stands indebted unto the plt in the full and just sum of nine hundred fifty and four pounds of tobacco as Per accompt (here in Court produced) it doth and may appear, which Sum the sd John Rousillo did faithfully assume and promise the plte to satisfie and pay, But the sd defendt litle regarding his sd Assumption fraudulently and craftily intending to deceive the plt of the same hath hitherto delayed, and at length denyed to pay the Same, though often thereunto required The plt sayes he is damnified and hath losse to the value of nineteen hundred and eight pounds of tobacco and hereupon brings this suit &c.
