(123) The perticulars on the other side folio 122. appraised this March 19th to the value of Eight thousand six hundred and sixty five pounds of tobacco for the use of mr ffrancis: Jenkins by vertue of a certain writt of attachment bearing date the 17th. Instant taken by us / John: IT. Townsend. Rowland Bevins. - - This endorsmt. was upon the back side of the Inventory his mark --and Ss. March Then mr John: Townsend and mr Rowland Bevins was sworne Appraisers of the goods and Chattels 19th. 1690- of Joseph ffreeman late of Somersett County in the Province aforesaid before me Edmund: Howard. No Garnishees appearing being legally sumoned and called in Court to show Cause why Execution should not be awarded agt: the goods Chattells debts and Creditts of the sd Josepn ffreeman to and for the use of the sd Jenkins, therefore the Court Orders Execution. agt. sd ffreeman &c. Then was this following Bill produced in Court viz. Know all men by the Mr. Peter: Bodkin. Sr / Pay unto mr George Layfield or his Order the sum of two thousand five hundred and eighty five pounds of good tobacco at Rehoberth Towne and in so doing you will Oblige --- your friend and humble servant to Command March 15th. 1688/9. Bodkin makes Oath in Open Court to a Deposition between Coleman & Webb which sd Deposition was signed pr Dept Clk. Court. but taken and kept pr mr. Peter Dent Thomas: Millman. Plt. Somerset County Ss/ James: Barry Tanner late of this County was agt. attached to answer unto Thomas: Millman in a plea of trespass on James: Barry. Deft the Case &c. And whereupon the plt by his Attorey James: Sangster Comes and sayth that he the said James in the year of our Lord 1688 became indebted unto the plt the full and just Sum of three thousand two hundred seventy and six pounds of tobacco as pr account here in Court produced, as will in Court more plainly appear the which account the defendant did faithfully promise to pay unto the plt, but he the James fraudulently intending the plt to deceive of the sum aforesd of 3276 pounds of tobacco, doth deny to pay the same although often thereunto required by the plt where upon saith he is damnified and hath damage to the value of 5000lb of tobacco, and thereupon bring this suit pr Quer Pledgs Deprs John: Doe James: Sangster.
