Which was read.
    The house, having qualified agreeably to the constitution and form of government, proceeded to
the choice of  a council to the governor, and the ballots being deposited in the ballot box, the gentlemen
named to strike retired, and after some time returned and reported, that William Kilty,
James Thomas, John Davidson, James Brice and John Johnson, Esquires, had a majority of votes.
Whereupon,
    RESOLVED, That William Kilty, James Thomas, John Davidson, James Brice and John Johnson,
Esquires, be, and they are hereby declared to be, council to the governor.
    The clerk of the senate delivers a letter from his excellency the governor of this day, enclosing a
letter of resignation from Richard Potts, Esquire, as senator to the United States, and also an address
from his excellency the governor, severally endorsed; " By the senate, November 16, 1796:
" Read and referred to the consideration of the house of delegates.
                                          " By order,                                              A.  VAN-HORN, clk.
Which were read.
    ORDERED, That Mr. Key, Mr. Carroll, Mr. John C. Thomas, Mr. Chapman and Mr. Barroll,
be a committee to consider and report on the address from his excellency the governor.
    The following messages being prepared, were sent to the senate by the clerk.

By the HOUSE of DELEGATES, November 16, 1796.
        GENTLEMEN OF THE SENATE,
    THE office of register of wills being vacant in the county of Charles, we propose, with the
concurrence of your house, to go into an election immediately.  Mr. Humphrey Barnes is nominated
by this house to fill this office, and we have appointed Mr. Edward Hall and Mr. Peter Emerson,
in conjunction with any members of your house, to examine the ballots.
                                          By order,                                                W.  HARWOOD, clk.
        GENTLEMEN OF THE SENATE
    THE office of register of wills being vacant in the county of Queen-Anne's, we propose, with
the concurrence of your house, to go into an election immediately.  Mr. William Hopper Nicholson
and Mr. James O'Bryon, the 3d, are nominated by this house to fill this office, and we have
appointed Mr. Edward Hall, and Mr. Peter Emerson, in conjunction with any members of your
house, to examine the ballots.
                                          By order,                                                W.  HARWOOD, clk.
    The report on the petition of negroes Jacob, Patt and Grace, was read the second time, concurred
with, and leave given to bring in a bill pursuant thereto.  ORDERED, That Mr. Robins,
Mr. Johnson and Mr. Sherwood, be a committee to prepare and bring in the same.
    A petition from Gassaway Watkins, of Anne-Arundel county, stating, that he purchased a certain
tract of land of the state, and praying further time for the payment of the purchase money, on
punctual annual payments of the whole interest, was preferred, read, and referred to Mr. Key, Mr.
Brogden and Mr. Hall, to consider and report thereon.
    The clerk of the senate delivers the following message:
By the SENATE, November 16, 1796.
        GENTLEMEN,
    IN answer to your message, we agree to proceed immediately to the election of a register of wills
for Charles county, and have appointed James Hollyday and John Thomas, Esquires, to join the
members of your house in the examination of the ballots.  No person is named by the senate in
addition to Mr. Humphrey Barnes.
                                          By order,                                                A.  VAN-HORN, clk.
Which was read.
    The house proceeded to ballot for a register of wills for Charles county, and the ballots being deposited
in the ballot box, the gentlemen named to strike retired, and after some time returned and
reported, that Humphrey Barnes was elected.  Whereupon,
    RESOLVED, That Humphrey Barnes be, and he is hereby declared to be, register of wills for
Charles county.
    The clerk of the senate delivers the following message.
By the SENATE, November 16, 1796.
        GENTLEMEN,
    In answer to your message, we agree to proceed, at two o'clock, top the election of a register of
wills for Queen-Anne's county, and have appointed James Hollyday and John Thomas, Esquires,
to join the members of your house in the examination of ballots.  No person is named by the
senate in addition to those mentioned in the message.
                                          By order,                                                A.  VAN-HORN, clk.
Which was read.
    The house proceeded to ballot for a register of wills for Queen-Anne's county, and the ballots being
deposited in the ballot box, the gentlemen named to strike retired, and after some time returned
