52            VOTES and PROCEEDINGS, November, 1796.

    The bill, entitled, An additional supplement to an act, entitled, An act to streighten and amend
the post road from Havre-de-Grace to Baltimore-town, was read the second time and will pass.

The senate adjourns until 5 o'clock.

    The senate met.
    The bill, entitled, An act respecting the roads in Somerset and Worcester counties, the bill, entitled,
An act to revive and continue the acts of assembly therein mentioned, the bill, entitled, An 
additional supplement to an act, entitled, An act for the relief of the poor of Calvert county, the
bill, entitled, An act to appoint an agent for the year one thousand seven hundred and ninety-seven,
with the amendment thereto, the bill, entitled, A supplement to an act, entitled, An act to incorporate
an insurance company in Baltimore-town, the bill, entitled, An additional supplement to an
act, entitled, An act relating to public roads in this state, and to repeal the acts of assembly therein
mentioned, as far as relates to Cæcil, Talbot and Kent counties, with the amendments thereto, the
bill, entitled, An act to empower John Erskine and John Thomas, administrators of Richard Johns,
to collect the balances due to Richard Johns as sheriff and collector of Talbot county, the bill, entitled,
An act to repeal the nineteenth section of the constitution, and to provide a new mode of 
electing senators, in case of refusal, death, resignation, disqualification, or removal out of this state,
of any senator, or on his becoming governor or member of the council, a bill, entitled, An act to
repeal part of the act of assembly therein mentioned, the bill, entitled, A supplement to the act,
entitled, An act for erecting a public school in Frederick county, the bill, entitled, An additional
supplement to an act, entitled, An act to streighten and amend the post road from Havre-de-Grace
to Baltimore-town, the resolution in favour of Charles Mankin, the resolutions relative to the finance
of the state, the resolution in favour of Mary Sherburn, the resolution in favour of Robert Long,
the resolution relative to negro Daniel, the resolution in favour of the adjutant-general, the resolution
relative to the bank stock, and the resolution in favour of Samuel Patterson Wallace, were sent to
the house of delegates by the clerk.
    The clerk of the house of delegates delivers to the clerk of the senate a bill, entitled, An act to
direct the manner of recording the commissions therein mentioned, thus endorsed; " By the house of
" delegates, December 27, 1796:  Read the first time and ordered to lie on the table.
                                                        " By order,                                W.   HARWOOD, clk.
" By the house of delegates, December 29, 1796:  Read the second time and will pass.
                                                        " By order,                                W.   HARWOOD, clk."
    Which was read the first and second time by especial order and will not pass, and was sent to the
house of delegates by the clerk.
The senate adjourns until to-morrow morning 9 o'clock.

F    R    I    D    A    Y,    December 30, 1796.

    THE senate met.  Present the same members as on yesterday.  The proceedings of yesterday
were read.
    The clerk of the house of delegates returns the bill, entitled, An act to revive and continue
an act, entitled, An act for the punishment of horse-stealers and other offenders, thus endorsed;
" By the house of delegates, December 20, 1796:  Read the first time and ordered to lie on the
" table."
                                                        " By order,                                W.   HARWOOD, clk.
" By the house of delegates, December 29, 1796:  Read the second time and will pass.
                                                        " By order,                                W.   HARWOOD, clk."
Which said bill was ordered to be engrossed.
    The clerk of the house of delegates delivers to the clerk of the senate the following message, and
the resolution therein mentioned.

By the HOUSE of DELEGATES, December 29, 1796.
        GENTLEMEN OF THE SENATE,
    WE return you the resolution in favour of Samuel Peterson Wallace, and hope you will reconsider
it.  The incompetency of the evidence exhibited to you, was, we presume, the reason of your
rejecting it.  As there will ne no other evidence brought forward to support his claim, we hope you
will, upon reconsideration, assent to it.
                                                        By order,                                  W.   HARWOOD, clk.
Which was read.
    THe clerk of the house of delegates delivers to the clerk of the senate the following message, together
with the bill and amendments therein mentioned.
By the HOUSE of DELEGATES, December 29, 1796.
        GENTLEMEN OF THE SENATE,
    WE have dissented from your first amendment to the bill, entitled, An act relating to negroes,
and to repeal the acts of assembly therein mentioned, and hope that upon reconsideration you will
pass the bill without insisting upon the same.  We cannot agree to this amendment, because it goes
to the competency of the witnesses born of free ancestors, and entitled to the privileges of citizens.
We think that the credibility of such persons ought always to rest with the jury of their country.
