unexecuted; therefore, Be it enacted, That James Carroll, Richard Caton,
Christopher Johnson,
David Williamson and George Pressman, or a majority of them, be and are
hereby authorised and
empowered to carry the provisions of the said act into execution, respecting
the said canal, in as full
and ample manner, to all intents and purposes, as the commissioners nominated
under the said recited
act might heretofore have done, any thing to the contrary thereof in
this present act notwithstanding;
and that they, or a majority of them, have full power and authority to
lay out and run
the said canal along Forest-street aforesaid, as far as convenient, towards
the said ferry branch; provided,
that in case the said commissioners, or a majority of them, shall not proceed
to open and
complete the said canal within the term of seven years from the passage
of this act, that then and in
such case all and every of the powers hereby vested in the said commissioners,
or a majority of them,
for opening said canal, and all powers heretofore in any manner vested
in any other persons by virtue
of the aforesaid act, entitled, An act to empower the commissioners fo
Baltimore-town to make a
correct survey of the said town, and for other purposes therein mentioned,
so far as the same relate to
the said canal, shall cease and be at an end."
Which was read the first and second time, agreed to,
and the bill ordered to be engrossed.
The resolution in favour of Robert Ramsey, endorsed; " By the senate, December

Amendments proposed. In the 6th line of the 1st
page strike out the words " George Walker"
and insert " Marsham Waring." In the 10th line of the 6th page strike
out from the word "pass"
to the end of the clause. In the 3d line of the 10th page strike
out the words "fifty-two" and insert
"sixty-six." In the 11th line of the same page, after the word "and"
insert " that the said
road shall be made." In the 4th line of the 12th page strike out
the words "thirty-two" and insert
"forty-six." In the 8th line of the 15th page strike out " or
deface any of the said line of
trees" and insert " deface or remove any." In the 7th line of the
17th page strike out the word
"two" and insert "four." In the 9th line of the same page strike
out the word "one" and insert
"two." In the 11th line of the same page strike out the word
"one" and insert "two." In the same
line strike out the word "half." In the 12th line of the same page

line of the same page strike
out the words " and no more" and insert as follows: " In which increase
they shall be regulated
by the net profits of the preceding year. And be it enacted,
That in case the said tolls, as hereby
first established, shall, in any one year from and after the term of two
years after the completion of
the said road, exceed in net profits the sum of ten per centum per annum,
then the legislature may,
at any subsequent session, and from time to time, reduce the said tolls,
provided that when thus reduced
they shall not yield in net profits a less sum than ten per centum
per annum; and in making
such reduction they shall be governed by the average of the clear income
and profits arising from the
tolls of the two years next preceding such reduction. And be it enacted,
That in case the tolls
should be increased by the said president and directors by virtue of the
authority herein before given
them, and when so increased they shall exceed in net profits the sum of
ten per centum per annum,
that then and in such case the legislature may, at any subsequent session,
and from time to time, reduce
the said tolls, provided that when thus reduced they shall not yield in
net profits a less sum
than ten per centum per annum; and in making such reduction they shall
be governed by the average
of the clear income and profits arising from the tolls of the two years
next preceding such reduction."
In the 5th line of the 22d page strike out the words " date of said incorporation"
and insert " choice
of the first directors as aforesaid." In the 3d line of the 25th
page strike out from the word "that"
to the end of the fourth line of the same page, and insert " if any part
of the said road, bridges or
causeways, upon which tolls shall have been received, shall be and continue
to be out of good and
perfect order and repair." In the 11th line of the 26th page strike
out from the word "names" to
the end of the clause, and insert " and that the same be subject to the
same disposition as other personal
property of the said intestate."

On motion, ORDERED, That the supplement to an act, entitled,
An act to regulate and discipline
the militia of this state, be referred to the next session of assembly.
