94 CONSTITUTIONAL CONVENTION OF MARYLAND [Sept 18]
appropriately to be considered in the Bill
of Rights of the Constitution as contrasted
to those matters which might properly be
left to the Legislature. There will be two
people to be heard tomorrow. One is Pro-
fessor Lewis Asper of University of Mary-
land Law School and the other is Professor
Rosen of the University of Maryland Law
School. I understand their views do not
coincide. We might expect a lively dis-
cussion. The matter came up before our
Committee in connection with the possible
consideration of abolition of capital punish-
ment and one of the problems originally
raised is whether it is a matter to be left
to the Legislature. We felt that in this and
other areas of interest, we should be pro-
vided with some sort of guide lines and
some sort of thinking on this to help us. It
occurs to us that there may be other com-
mittees which would have similar interests
and might want to send representative to
this hearing, or if possible, if enough peo-
ple were interested, we might have it in a
larger hearing room.
We do expect to have it stenographically
reported, if people are that much interested.
The hearing along the general lines, will
continue on Wednesday, and if any commit-
tee chairman or committee members have
particular points that they might want to
have these gentlemen or others elaborate
on, I would be glad to hear from them.
THE PRESIDENT: Delegate Mudd.
DELEGATE MUDD: Mr. President, the
Committee on the Judicial Branch will meet
tomorrow morning at 10:00 A.M., in the
usual place, the ground floor of this build-
ing at 10:00 A.M. I also would like to an-
nounce at this time that the Committee on
Judicial Branch had the honor of electing
Judge William Henderson Vice-Chairman of
the Committee on the Judicial Branch and
I look forward to serving with him in that
capacity.
May I also remind the delegates that on
Friday, September 22, at 10:00 A.M., the
Committee on the Judicial Branch will be
concerned specifically with those sections
of the proposed draft Article V, having to
do with the selection and tenure of judges,
a subject we feel of general interest to all
delegates, and we welcome their attend-
ance.

THE PRESIDENT: Any further an-
nouncements by committee chairmen ?
DELEGATE GALLAGHER: Mr. Presi-
dent, the Committee on the Executive
Branch will not meet after today's pre-
liminary session, but will meet tomorrow
morning at nine-thirty.
THE PRESIDENT: Delegate Gallagher,
did you mean to say the Committee on the
Executive Branch ?
DELEGATE GALLAGHER: Legislative.
We will take all the jurisdiction we can,
Mr. President. At nine-thirty, tomorrow
morning, Professor Winslow will talk to us
and after the session tomorrow, Dr. Jean
Spencer will talk to the Committee. On
Wednesday, we are inviting all the mem-
bers of the Constitutional Convention who
are present members of the General As-
sembly to appear before the Committee and
discuss some of the general matters before
the Committee itself.
THE PRESIDENT: Delegate Moser?
DELEGATE MOSER: Mr. President, the
Committee on Local Government will meet
tomorrow at 9:00 A.M. We will have present
at that time representatives of Anne Arun-
del County, Mr. Alton, Mr. Whitmore, and
Mr. Crain. At 11:00 A.M., representatives
of Charles County, St. Mary's County,
Somerset County, and Talbot County, will
be present.
THE PRESIDENT: Any other an-
nouncements by committee chairmen? Dele-
gate Morgan?
DELEGATE MORGAN: Mr. President,
just to get back to my jurisdiction, I would
like to announce that the Committee on the
Executive Branch will meet within five or
ten minutes after the adjournment of this
session this afternoon.
THE PRESIDENT: Delegate Sherbow?
DELEGATE SHERBOW: Mr. President,
I want to announce the Committee on State
Finance and Taxation will meet immedi-
ately after this session is over. We will
meet tomorrow morning at 9:30 A.M. That
is a slight change in plan and the public
hearings will begin tomorrow at 10:00 A.M.
I would like to suggest to the rest of the
Convention and to the delegates, that if
you see any witnesses wandering around
wanting to know where the Shaw House is,
just tell them it is across the street where
the oldest club used to be. People have
trouble finding us.
THE PRESIDENT: Thank you. Are there
any other announcements by committee
chairmen? Delegate Scanlan?
DELEGATE SCANLAN: Mr. President,
the Rules Committee will meet tomorrow
