appropriation for maintaining State gov-
ernment," and I underline the word "main-
taining", and it also says that there "shall
be exempt any bill for aiding or maintain-
ing a public institution".
Now, the word "maintaining" is not a
word couched in capital terms. That is to
say, this word would not in my opinion
cover a capital expenditure. It is more of
an expense nature. Therefore, I suggest
the elimination of the words "maintaining
the State government" or "for the aiding
or maintaining", and inserting in lieu
thereof the words "State government", so
that the bill would now read, or the pro-
posal would now read, "and there would
be exempt from referendum, any law pro-
posing a tax or any law making an ap-
propriation for the State government or
any public institution".
If this were done, it would be absolutely
clear that bond issues would not be sub-
ject to referendum, and this would mean
in substance that the law would be in ef-
fect, after the new Constitution were
adopted, as it had been heretofore.
Therefore, Mr. Chairman, I move the
amendment.
THE CHAIRMAN: Does any other dele-
gate wish to speak for or against?
Does anyone wish to question Delegate
Case for the purpose of clarification? Are
there no questions or further debate? The
question arises on Delegate Case's amend-
ment. The Chair recognizes Delegate Car-
din.
DELEGATE CARDIN: Mr. Chairman,
I was just going to say that as Chairman
of the subcommittee on referendum, we did
consult with Delegate Case, and we were
advised this would be a correction which
would facilitate and make a matter of fact
the fact that bonds were not subject to
referendum, and that is as we wish it to
be so the subcommittee on referendum
would request that this be adopted by the
Committee of the Whole.
THE CHAIRMAN: The question arises
on the adoption of the amendment. All in
favor, say Aye; opposed, No. The Ayes
have it. It is so ordered. Amendment No. 4
is adopted.
Is Amendment No. 3 available? I under-
stand it will be approximately ten minutes
before Amendment No. 3 will be available.
In the meantime, while we are waiting,
the Chair will make some announcements.
From Chief Curry of the Tour Service
on the subject of tour groups attending
today, we have a group of five or more
teachers of Calvert County High School
who are attending committee meetings of
the General Session. We are happy to wel-
come them here.
(Applause.)
I have a message from Delegate Ander-
son which says that he will be glad to ex-
change overcoats with the party who by
inadvertence removed his overcoat last
week from the Legislative Committee room
and left another in its place.
This happens to everybody at least once.
I would like to recognize Delegate Wins-
low.
DELEGATE WINSLOW: Mr. Chair-
man, an inquiry, please: I think this ques-
tion was raised the other day.
I am sorry to say I did not get the an-
swers, but does section 2 as it now stands,
keep a referendum out of possibility with
respect to an appropriation to a private
institution? Say if the appropriation is for
St. John's College or for a privately en-
dowed hospital, are such appropriations
subject to a referendum?
THE CHAIRMAN: Will the Chairman
of the Committee answer that question?
DELEGATE KOSS: Yes. It was not the
intent of the Committee to exclude appro-
priations for private institutions from ref-
erendum. Does that answer your question?
DELEGATE WINSLOW: Yes.
THE CHAIRMAN: The Chair would
like to recognize Delegate Clarence Mitchell
from the Fourth District of Baltimore City.
We are happy to have you with us.
I have a message from Delegate E. J.
Clarke that Mrs. Joseph M. Dukert, wife
of the Chairman of the Republican State
Committee passed away Sunday. She was
very active in civic affairs and, as a Re-
publican, served in precinct, county, city,
state and national capacities. She served
her party and the people of Maryland in a
most distinguished manner. We will not
only miss her fruitful contributions but
her warm personality and friendship as
well.
For those desiring to attend the funeral
mass at 10:00 A.M. at the Cathedral of
Mary Our Queen in Baltimore, arrange-
ments have been made for transportation
