position to the amendment?

The question arises on the adoption of
Amendment No. 15 to Committee Recom-
mendation LB-1. A vote Aye is a vote in
favor of the amendment. A vote No is a
vote against.
Cast your vote.
Has every delegate voted? Does any dele-
gate desire to change his vote?
(There was no response.)
The Clerk will record the vote.
There being 4I votes in the affirmative,
89 in the negative, the motion is lost. The
amendment is rejected.
Are there any further amendments to
section 3.05? If not, we will proceed to con-
sideration of section 3.06.
DELEGATE GALLAGHER: Mr. Chair-
man.
THE CHAIRMAN: Delegate Gallagher?
DELEGATE GALLAGHER: I had ex-
pected there would be another amendment.
THE CHAIRMAN: To section 3.05?
DELEGATE GALLAGHER: Yes, sir,
but I wanted to give that an opportunity
before I offered the amendment about which
I spoke to the Committee of the Whole a
few moments ago.
Mr. Peters had planned to offer an
amendment.
THE CHAIRMAN: Delegate Peters, do
you have an amendment to 3.05?
DELEGATE PETERS: I will not offer
mine.
THE CHAIRMAN: Delegate Gallagher.
DELEGATE GALLAGHER: In that
event, if there be no other amendment, I
do have an amendment.
DELEGATE BOILEAU: Mr. Chairman.
THE CHAIRMAN: Delegate Boileau,
for what purpose do you rise?
DELEGATE BOILEAU: I have an
amendment being prepared.
THE CHAIRMAN: For what section?
DELEGATE BOILEAU: For the section
which we just voted on.

DELEGATE GALLAGHER: My pro-
posed amendment, Mr. Chairman, would be
on line 28 of page 2, Section 3.05.
THE CHAIRMAN: We will take your

marked on.
THE CHAIRMAN: This will be Amend-
ment No. 16 to Committee Recommendation
LB-I.

READING CLERK: Amendment No. 16
to Committee Recommendation LB-I by
Delegate Gallagher, Francis X. Chairman,
Committee on Legislative Branch: On page
2 line 28 of Committee Recommendation
LB-I in between the words "redistricting."
and "To" add the following sentence:
"No person shall seek election to or be
appointed to more than one seat in the
General Assembly at a time."
THE CHAIRMAN: Is the amendment
seconded?
(Whereupon, the amendment was duly
seconded.)
THE CHAIRMAN: The Chair recog-
nizes Delegate Gallagher to speak to the
amendment.
DELEGATE GALLAGHER: Mr. Chair-
man and ladies and gentlemen, in the pres-
ent Constitution of Maryland, in Article
III, Section 1I, there is a part of a provi-
sion which says, "No person holding any
civil office of profit or trust under this
state except justices of the peace shall be
eligible as senator or delegate."
There is another provision with respect
to holding more than one office of profit or
trust that does not, as I see it, prevent
someone from seeking more than one office
of profit or trust. Because of the possi-
bility that one could run for both the sen-
ate, and the house within the same sena-
torial district, and because I believe this
question has been raised on Tuesday and
again today, I thought it would be appro-
