Delegate Johnson?
DELEGATE JOHNSON: Mr. President,
I would ordinarily leave this announce-
ment for announcements, but if we have
time, with the lull in the Committee of the
Whole, perhaps I can make an announce-
ment with respect to a minority report.
THE CHAIRMAN: All right.
DELEGATE JOHNSON: Mr. Chair-
man, because JB-I contains the majority
view of the Judicial Branch, of the entire
judicial article and since some inquiries
were made concerning the minority view, if
any, I should like to announce that a mi-
nority report is being prepared to some of
the recommendations of the majority re-
port, and with some luck this will be dis-
tributed to the delegates Wednesday, No-
vember 8.
Mr. Chairman, I was given to under-
stand that the Committee Calendar had its
schedule full through Thursday and that
JB-I would have to be considered some-
time soon thereafter. As Temporary Chair-
man for the Minority Report, 1 join our
Majority Chairman Mudd in a request to
the Calendar Committee that JB-I be con-
sidered no earlier than Monday, Novem-
ber 13. Representatives of each Committee
are desirous that the Committee of the
Whole have both the majority and minority
reports before it so that a full and frank
discussion of the relative merits of each
can be made. Perhaps with everyone's co-
operation, this will be accomplished.
THE CHAIRMAN: Delegate Johnson, I
doubt if we can do that, much as we would
like to. If the consideration of the recom-
mendation of the Committee on the Judicial
Branch were deferred, we would have at
least one and perhaps two blank days. This
would mean that it would be imperative
for us to sit this Saturday and the next
Saturday.
Is it possible for your minority report
to be concluded this afternoon? If so, we
can have it printed tonight and distributed
tomorrow morning.
DELEGATE JOHNSON: I do not .think
it is possible for it to be completed this
afternoon, Mr. Chairman. I think there is
the possibility that it can be completed to-
morrow. I want to reiterate that the mi-
nority is not suggesting that there be any
blank days or that consideration of the
majority report be deferred. For this rea-
son and for that matter, any other reason,
but we were operating under the impres-
sion that the calendar had a full schedule
through Thursday of this week, and the
reason that I arise is because you an-
nounced earlier that it was possible for
JB-I to be considered on Thursday. I just
wanted to make our position clear. We will
work all the harder to complete our task
so that there will be no delay in the matter.
THE CHAIRMAN: If you could possi-
bly finish your minority report or even
part of it tonight, it would be helpful.
I believe the amendment to be offered by
Delegate Rybczynski has now been pre-
pared and is circulated. The Chair recog-
nizes Delegate Rybczynski. Is this the
amendment you desire to offer?
DELEGATE RYBCZYNSKI: Yes.
THE CHAIRMAN: We will mark it
Amendment No. 1. The Clerk will read the
amendment.
READING CLERK: Amendment No. I
to Committee Recommendation No. GP-2
by Delegates Rybczynski and Rush: On
page 1, line 12 of Committee Recommenda-
tion GP-2, after the quotation mark, insert
the words: "In the presence of Almighty
God".
THE CHAIRMAN: The Chair recog-
nizes Delegate Rybczynski.
DELEGATE RYBCZYNSKI: Mr.
Chairman, I want to make it very clear—
THE CHAIRMAN: Just for the pur-
poses of moving the amendment.
DELEGATE RYBCZYNSKI: I want to
make clear that what was just read was
not complete. I want to emphasize the pa-
rentheses before and after, so that I now
move the Amendment No. 1 to Committee
Recommendation GP-2.
THE CHAIRMAN: Is there a second?
(Whereupon, the motion was seconded.)
THE CHAIRMAN: So that I can be
clear as to what you just said, Delegate
Rybczynski, it is my understanding that
you intend the amendment to include, not
only the phrase, "in the presence of Al-
mighty God", but also the parentheses
around that phrase?
DELEGATE RYBCZYNSKI: Yes, sir.
THE CHAIRMAN: The Chair recog-
nizes Delegate Rybczynski to speak to the
amendment.
DELEGATE RYBCZYNSKI: Mr.
