3378 CONSTITUTIONAL CONVENTION OF MARYLAND [Jan. 6]

The question arises on the adoption of
sections 6.01 to 6.16 inclusive of Article 6.
A vote -Aye is a vote in favor of the adop-
tion of these sections of Article 6; a vote
No is a vote against.

Cast your votes.
Has every delegate voted?

Does any delegate desire to change his
vote?

(There was no response.)

The Clerk will record the vote.

There being 115 votes in the affirmative
and 9 in the negative, the motion is carried
and sections 6.01 to 6.16 inclusive of Ar-
ticle 6 are adopted on third and final
reading.

The question now arises on the adoption
on third and final reading of section 6.17.

Is there any discussion?
Delegate Kosakowski.

DELEGATE KOSAKOWSKI: Mr. Pres-
ident, and members of this Convention : In
lieu of what happened yesterday and today
in cleaning up the Constitution, I feel that
this provision does not belong in a modern
constitution.

I do not want to belabor the issue. You
are all aware of how we are going to vote.
I appeal to the members here, and even the
committee members on Finance, to let you
know you are not bound by any vote that
you had cast in the committee. None of us
are bound by any vote cast in the Commit-
tee of the Whole. I appeal to the member-
ship in your wisdom, and I hope your gen-
erosity in deleting this section, because it
does not belong in the Constitution.

THE PRESIDENT: Delegate Sherbow.

DELEGATE SHERBOW: Mr. President,
ladies and gentlemen, I earnestly hope that
you will vote for this provision. It was de-
bated fully before the Committee on State
Finance and Taxation and came out with
an overwhelming vote in its favor.

It was debated here on the floor and an
amendment was passed. It was debated on
second reading and was passed.

I think that you should bear in mind
that there is no reason now to change, and
while we require seventy-two votes, I think

you also should bear in mind that this is at
the present time a part of our present
Constitution, and if you delete this, you
should also bear in mind that all of the
localities, the cities and the counties, with-
out waiting for the General Assembly, may
proceed with their own lotteries.

This is different from saying leave it up
to the General Assembly. It just is no
longer a valid argument.

I ask you to bear in mind that we can-
not submit these lottery proposals that the
subdivisions, as well as the General As-
sembly, may pass to referendum, because
they will be attached to a money appropria-
tion. This will prevent the people from hav-
ing an opportunity to vote on it.

I strongly feel on this subject, but I ask
you, with no emotion, with nothing but
logic, to bear in mind that there is no rea-
son for taking this out of the present Con-
stitution and taking it out now at this late
stage in these proceedings.

I strongly urge you to vote for it and
let us go before the people with a Constitu-
tion that they can accept. I hope we ap-
prove this section.

THE PRESIDENT: Does any other dele-
gate desire to speak in opposition to the
section?

Delegate Johnson.

DELEGATE JOHNSON: I move the
previous question, Mr. President.

(Whereupon, the motion was duly sec-
onded.)

THE PRESIDENT: The question arises
on the motion to order the previous ques-
tion on the adoption of section 6.17. All in
favor, signify by saying Aye; contrary, No.

The Ayes have it. It is so ordered.

The question arises on the adoption on
third and final reading of section 6.17, on
page 42. A vote Aye is a vote in favor of
the adoption of the section; a vote No is a
vote against.

Cast your votes.

Does any delegate desire to change his
vote?

The Clerk will record the vote.

There being 68 votes in the affirmative
and 44 in the negative, the motion failed.
