3368 CONSTITUTIONAL CONVENTION OF MARYLAND [Jan. 6]

THE PRESIDENT: The question arises
on the motion to order the previous ques-
tion on the adoption of Amendment No. 8
to Report S&D-18. All in favor signify by
saying Aye; contrary, No.

The Ayes have it. It is so ordered.
The Clerk will ring the quorum bell.

The question arises on the adoption of
Amendment No. 8. A vote Aye is a vote in
favor of the amendment. A vote No is a
vote against.

Cast your votes.
Has every delegate voted?

Does any delegate desire to change his
vote?

(There was no response.)
The Clerk will record the vote.

There being 48 votes in the affirmative
and 77 in the negative, the motion is lost.
The amendment is rejected.

THE PRESIDENT: Delegate Hard-
wicke, do you desire to offer your Amend-
ment L?

DELEGATE HARDWICKE : Yes, Mr.
President.

THE PRESIDENT: Pages, please dis-
tribute Amendment L.

For what purpose does Delegate James
rise?

DELEGATE JAMES: A point of in-
quiry, Mr. President. In submitting the
question to vote, will a vote on Article 1
include a transitional provision relating to
Article 1?

THE PRESIDENT: It will not. The
transitional provision schedule will be sub-
mitted to vote as a separate schedule.

Delegate James.

DELEGATE JAMES: Will the entire
schedule be submitted or will the articles
be submitted?

THE PRESIDENT: The entire schedule
will be submitted as one division to be
voted on at one time.

This will be Amendment No. 9.
The Clerk will read the amendment.

READING CLERK: Amendment No. 9
to Report S&D-18 by Delegate Hardwicke.
On page 53, section 6, Delayed Effect of
Certain Sections, in line 39 after the nu-
merals: "3.03" add the following: ", 3.04";

and in line 45 strike out the following:
"section 3.03" and insert in lieu thereof the
following: "sections 3.03 and 3.04".

THE PRESIDENT: The amendment is
submitted by Delegate Hardwicke: Is there
a second?

(Whereupon, the motion was duly sec-
onded.)

THE PRESIDENT: The amendment is
seconded.

The Chair recognizes Delegate Hardwicke.

DELEGATE HARDWICKE: Mr. Presi-
dent, this is merely a housekeeping amend-
ment. "3.04 was amended since we drew
the transitional provisions, and it now con-
tains the provision with respect to the divi-
sion of Senate districts into three districts
for the House of Delegates, and we have
to suspend that along with the other pro-
visions with regard to the new legislature
until the election of 1970, and the purpose
of this is to make it clear that that pro-
vision also is suspended until 1970, and it
is in keeping with other things we have
done and I urge its adoption.

THE PRESIDENT: Is there any dis-
cussion?
