3366 CONSTITUTIONAL CONVENTION OF MARYLAND .[Jan. 6]

The Clerk will record the vote.

There being 111 votes in the affirmative
and 9 in the negative, the motion is car-
ried. The amendment is adopted.

Are there any other amendments to Ar-
ticle 9?

Delegate Cardin.

DELEGATE CARDIN: Mr. President,
I have waited for an amendment to have
been printed, which was submitted at least
half an hour or forty-five minutes ago, to
section 9.01 pertaining to the oath. It is a
very simple amendment. It was submitted
once before under another reading.

THE PRESIDENT: Amendment Q, has
it been printed?

Amendment Q, the Chair has a typewrit-
ten copy. It is in the print shop. It will be
perhaps fifteen minutes, maybe ten, before
it is back. It would amend section 9.01 on
page 47 in line 10, to strike out the phrase,
parentheses, "In the presence of Almighty
God", close parentheses. Is there any ob-
jection to considering the amendment, not-
withstanding the fact that it is not printed
with the understanding the printed amend-
ment will be on your desk very shortly? Is
there any objection?

The Chair hears none.

DELEGATE NEILSON: Mr. Chairman,
I do not think I understood when you re-
peated what was stricken out. I think, al-
though I am against the idea that Mrs.
Cardin is presenting, but to get it properly
on the floor, should we not have to go back
to line 9 and strike out the explanation?

THE PRESIDENT: I take it that that
would be necessary. In line 9 strike out the
phrase —

I am sorry. It could remain as applicable
to the words "or affirm" even though it
was not there originally. The Chair sug-
gests we could make better time to act on
it. The amendment is easily understood :
line 10, page 47, strike out the parentheti-
cal expression.

Is there any objection to considering the
amendment, notwithstanding the fact that
it is not printed?

The Chair hears none. This will be
Amendment No. 8. The Clerk will read the
amendment.

READING CLERK: Amendment 8 to
Report S&D-18 by Delegates Cardin, Ross,

and Marion. On page 47, section 9.01, Oath,
in line 10 strike out the following: "(In
the presence of Almighty God)".

THE PRESIDENT: I would like to
make an announcement before we consider
this. The chief page advises me that the
reprinted pages for those pages of this
report which were blank on the copies of
some delegates are here. They can be dis-
tributed. To avoid confusion, when I ring
the bell, will every delegate who has any
blank page put on his red light and leave
it on and the pages will then know who is
missing a page. We will come to you and
supply you with the correct ones. The
pages are 19, 31, 24, 36, 28. Instead of
using the roll call lights, Mrs. Marx tells
me she can pick it up just as easily if you
will put on your signal light. Put on the
light that you signal for a page if you are
missing any of those page numbers. Put
your light on and leave it on until the page
has given you the new sheets.

Delegate Sybert.

DELEGATE SYBERT: Mr. Chairman,
I suggested sometime back that page 42 is
also missing, and you said you would add it
to the list.

THE PRESIDENT: That is one of the
numbers included, 42.

Delegate Clagett.

DELEGATE CLAGETT: I am missing
49, Mr. Chairman.

THE PRESIDENT: 49 is also reprinted,
I understand.

Correction. It has not been reprinted.

Amendment No. 8 submitted by Delegate
Cardin, seconded by Delegates Koss and
Marion.

The Chair recognizes Delegate Cardin.

DELEGATE CARDIN: Mr. President,
fellow delegates, I will not take up much
of the valuable time of this Convention.

I would just like to make three points
since we have been through this ground
before.

First, in checking with three or four
constitutional attorneys who are not in-
volved with this Convention, I have found
that there still is a doubt as to the consti-
tutionality of this particular clause. Not
that it will affect the Constitution itself,
but it would affect this particular oath.

Second, we had struck out Article 37 that
required no religious test other than the
