contrary opinion from that which you
gave, Mr. President, that the definition in
the Constitution would carry over, but if
there is any question about it, then I
would suggest that we include two defini-
tions in the schedule.

One definition would define "counties"
as including Baltimore City, and the other
one would define "prior Constitutions".

THE PRESIDENT: The Chair would
concur in your first recommendation, but
I think it would be dangerous to include
the statute because you would be in stat-
utes referring to prior Constitutions.

It might be clear so far as this Schedule
is concerned. I do not know.

Does the phrase "prior Constitution"
occur more than one time when the Com-
mittee has corrected it, or does reference
to the Constitution occur more than one
time?

Delegate Grant.

DELEGATE GRANT: It occurs on
page — I am sorry. I am in error.

THE PRESIDENT: Delegate Marion.

DELEGATE MARION: I think the
words "prior Constitution" and "this Con-
stitution" occur several times in the course
of the various provisions.

THE PRESIDENT: I will request the
staff working on this to prepare immedi-
ately an amendment to incorporate in the
schedule of legislation, a definition of
"prior Constitution" and a definition to
say "county" includes Baltimore City, and
to make such other changes in the sched-
ule that are necessary to conform.

DELEGATE CHABOT: Page 65, line 39
in section 2, the phrase in parentheses
which is carried over from the present
Constitution?

THE PRESIDENT: I must have mis-
understood you. You say page 65, line 39?

DELEGATE CHABOT: Line 39.
THE PRESIDENT: Page 65?
Delegate Chabot.

DELEGATE CHABOT: The phrase "as
the case may be". Did I say in parentheses?
The phrase "as the case may be" within
the commas is carried over from the old
Constitution because the old Constitution

referred to the county or Baltimore City
as the case may be. Since we no longer
have the reference to Baltimore City, I
think there is no further need for that
phrase.

THE PRESIDENT: It seems to the
Chair that is correct. Do you agree. Dele-
gate Hardwicke?

DELEGATE HARDWICKE: Yes, I do,
Mr. President, and the same problem arises
on page 69 in line 34. That reference to
Baltimore City should be stricken, the
whole line, as a matter of fact, should be
stricken.

THE PRESIDENT: Is there any objec-
tion to modifying the committee recom-
mendation to strike out of line 39 on page
65 the phrase "as the case may be"?

The Chair hears none. The modification
will be made. Is there any objection to
modifying the Committee's report so as to
strike out on page 69 all of line 34?

The Chair hears none. The modification
will be made.

I take it that we would also, in that
event, strike the comment after the word
"occurs" in line 33 on page 69? The modi-
fication will be made.

Delegate Hardwicke.

DELEGATE HARDWICKE: Mr. Presi-
dent, there may be some more of these and
we may not be picking them all up in this.

THE PRESIDENT: Yes, I want Mr.
Adkins and Mr. Miller in preparing the
amendments suggested to go through care-
fully and try to pick these up.

Delegate Hardwicke.

DELEGATE HARDWICKE: I see an-
other one on page 70, lines 44 and 45, the
reference to Baltimore City should be
stricken.

THE PRESIDENT: Any objection to
striking the words "or Baltimore City" in
lines 44 or 45 on page 70?

The Chair hears none.
Delegate Henderson.

DELEGATE HENDERSON: If we
might revert for a moment to page 66, line
19, there is a reference to such county or
counties. I do not find any such previous
reference to a county for which the "such"
would go back although it is probably
implicit in the candidate for continuance
