3038 CONSTITUTIONAL CONVENTION OF MARYLAND [Jan. 2]

Amendment No. 5 is pending and before it
is voted upon they may offer their amend-
ment to section 1.17.

Is there any question about the pro-
cedure?

One thing I do want to make clear is
that this choice comes after the vote to re-
consider. The amendments would not be
in order pending the motion to reconsider.

Delegate Bamberger.

DELEGATE BAMBERGER: Mr. Presi-
dent, if the motion to reconsider fails, will
amendments to section 1.17 be in order?

THE PRESIDENT: If the motion to re-
consider fails, then Amendment No. 5 is
still rejected. Section 1.17 is before the
Convention. It is open to further amend-
ment, assuming the further amendment is
not in contradiction to some amendment
previously adopted ,and I could not tell you
that without seeing it.

DELEGATE BAMBERGER: Did the
Chair state that the delegates who pro-
posed to offer these several amendments
had indicated any intent? Which of all the
alternatives did they choose, to offer the
amendments in the event the motion to re-
consider passes, before or after we vote on
Amendment No. 5?

THE PRESIDENT: Yes and no. Some
did choose, some did not.

In at least one instance where there was
an indication that they would probably
offer the amendment while the vote to
adopt or reject Amendment No. 5 was
pending, there was a suggestion to the
Chair later that they might not; so the
Chair does not know.

However, the Chair would be disposed
to recognize at the appropriate time as the
first of the amendments the one that was
offered by Delegate Scanlan, because I had
indicated that before, except that he ad-
vised me that he had revised it. I am not
certain I have it here, but I will look.

Delegate Scanlan, is the amendment that
is marked here as "FF" the one that you
proposed to have in lieu of the one that
you had prepared several days ago?

DELEGATE SCANLAN: That is cor-
rect, Mr. President.

THE PRESIDENT: Then there was an
amendment by Delegate Adkins, "GG".

Delegate Adkins, is that the amendment
that you would propose to offer at what-
ever the appropriate time is?

DELEGATE ADKINS: At the moment,
my answer to that would be yes, Mr. Presi-
dent.

THE PRESIDENT: I am not suggest-
ing you tell us when; that is up to you.

DELEGATE ADKINS: I am reserving
a certain amount of flexibility in the
matter.

THE PRESIDENT: None of the other
amendments that I have were ones that
were here the other day.

Delegate Bamberger.

DELEGATE BAMBERGER: Mr. Presi-
dent, would the Chair ask the pages to dis-
tribute to the other delegates those amend-
ments?

I suppose that the sponsors of them, if
they have had any second thoughts and do
not intend to offer them, should not have
them distributed.

THE PRESIDENT: The Chair would
not want to distribute any amendments
that the sponsors did not want distributed.
The fact that they are passed up to the
Chair is merely for the Chair's informa-
tion.

The Chair would be glad to have dis-
tributed any amendments that sponsors of
the amendments desire to have distributed.

Delegate Bamberger.

DELEGATE BAMBERGER: I then
would ask the sponsors if they would con-
sider indicating to the Chair if they think
it would be helpful for us to have those
amendments before us.

THE PRESIDENT: I intended that by
the comment I just made.

The Chair will order distributed any
amendments which the sponsors desire dis-
tributed.

Delegate Scanlan.

DELEGATE SCANLAN: Mr. Chair-
man, would you distribute "FF"?

THE PRESIDENT: Will the pages
please distribute Amendment "FF"?

Delegate Sherbow?

DELEGATE SHERBOW: Mr. Presi-
dent, I have no objection to the distribution
of the amendment marked "CC", which
would be offered only in the event 1.17
should be before the house.

THE PRESIDENT: The Chair will not
distribute unless you request it.
