DELEGATE MALKUS: Mr. Chairman,
I rise to oppose this type of shenanigan.
That is exactly what it is. In all good faith
we adopted these rules. For heavens sake,
if they were good a half hour ago, they
ought to be good today and now. I have no
great interest in who is Chairman of this
Convention, President of this Convention,
but I believe in honesty and decency in
government, and if this Convention is going
to go back and forth by suspending the
rules, we are going to be in turmoil.
ALTERNATE TEMPORARY CHAIR-
MAN: As I understand the motion of the
gentleman, it was to suspend Rule 3, is it?
DELEGATE GLEASON: That is right,
Mr. President.
ALTERNATE TEMPORARY CHAIR-
MAN: The gentleman moves to suspend
Rule 3. A vote Aye suspends the rule, a
vote No rejects it. Chair recognizes the
gentleman from Baltimore City.
DELEGATE WHITE: Presiding Offi-
cer, I rise to insist that we adhere to and
do not suspend the rule, that we follow the
procedure set out. I thank you.
ALTERNATE TEMPORARY CHAIR-
MAN: Yes, now is on suspension of rules.
All those in favor, signify by saying Aye.
Opposed, No. Noes seem to have it, Noes
have it. Chair recognizes the gentleman
from Anne Arundel County.
DELEGATE FORNOS: I move for a
ten-minute recess.
ALTERNATE TEMPORARY CHAIR-
MAN: Gentleman moves for a ten-minute
recess. A vote Aye will recess the Conven-
tion for ten minutes, a vote No will leave
the Convention in session. All those in
favor, signify, by saying Aye. Opposed, No.
The chair is not in doubt.
We will proceed with another roll call
for President of the Convention. Three
nominees again, Mr. Clark, Mr. Eney, and
Mr. James.
(At this point a roll call was made.)
ALTERNATE TEMPORARY CHAIR-
MAN: While the tellers are checking these
ballots, we will take a short recess.
(A short recess was taken.)
ALTERNATE TEMPORARY CHAIR-
MAN: Will the delegates please take their
seats. The Convention will please come to |
order. Secretary will call the roll to de-
termine the presence of a quorum.
(At this point a roll call was made.)
ALTERNATE TEMPORARY CHAIR-
MAN: Quorum being present, the Conven-
tion is in session. I have been asked by the
President pro tem to approach the rostrum.
THE CHAIRMAN: Mr. Speaker, mem-
bers of the Convention, I would like to
move that we name H. Vernon Eney perma-
nent President of the Constitutional Con-
vention by acclamation. [The vote for Presi-
dent of the Convention was Eney 71, James
36, Clark 32. The tellers had checked the
ballots while the Convention was in a ten-
minute recess.]
(Applause.)
ALTERNATE TEMPORARY CHAIR-
MAN: The Convention will please come to
order. The Chair recognizes the gentleman
from Howard County.
DELEGATE J. CLARK: Mr. Chairman,
it gives me a great deal of pleasure to
second that motion.
(Applause.)
ALTERNATE TEMPORARY CHAIR-
MAN: I do not think there is need to take
a vote on the motion. Under the rules, the
gentleman still needs a majority. For the
record, we better have a roll call. Call the
roll.
(At this point there was a roll call made.)
ALTERNATE TEMPORARY CHAIR-
MAN: Anyone wish to be recorded in the
negative? If not, H. Vernon Eney is elected
unanimously as the President of the Con-
vention.
(The vote on the motion was Aye 139, No
none.)
(Applause.)
ALTERNATE TEMPORARY CHAIR-
MAN: The Convention will please come to
order. I would like to have Delegate Clark
and Delegate James escort Mr. Eney to the
rostrum.

THE CHAIRMAN: It is my final duty as
Temporary Chairman to swear in our new
permanent presiding officer. It gives me
great pleasure to ask Vernon Eney to raise
his right hand and repeat after me.
