recollection is that we had done it the other
way around, and it should read "qualified
voter" in this instance.
DELEGATE PENNIMAN: This is one
of those items that we did very early, before
we had made the uniform rule to use
"qualified". So if you will, we will return
"registered voter" to the original language
of "qualified voter". It is section 3.07, page
3, line 17.
DELEGATE JAMES (presiding): If
there is no objection, the word "registered"
on line 17, section 3.07, will be changed to
"qualified".

DELEGATE B. MILLER: In section
3.12, line 38, "any committees or subcom-
mittees", I do not believe the "s" should be
on either word.
DELEGATE PENNIMAN: I rather think
it should be there, including; .the proceed-
ings of any committees or any subcommit-
tees. It could be removed, I guess.

DELEGATE CASE: Delegate Penniman,
on page 9, line 2, the exception there says
"pertaining to public education". Article 8,
which deals with the subject education
breaks the matter down into public educa-
tion and higher education.
Am I correct in understanding that this
exception would run to higher education as
well as public education as there defined ?
DELEGATE PENNIMAN: These were
the words suggested, I believe, by the peo-
ple supporting, or the people who wrote
that Article 8, and I guess I would prefer
to ask Delegate Maurer or Delegate Lord,
if he is here, to reply to your question,
Delegate Case.
DELEGATE JAMES (presiding): Dele-
gate Maurer.
DELEGATE MAURER: I do not see
Delegate Lord. I think he would be the ap-
propriate person.
Most of the laws dealing with higher
education are by their very nature public
general laws, but it would also seem that
the section on higher education, 8.04, means
public higher education and not private
higher education; and therefore, public edu-
cation would refer to both sections. Per-

haps it would be better if we titled the
second section under the education article
as public higher education.
DELEGATE JAMES (presiding): Dele-
gate Case.
DELEGATE CASE: I think, Mr. Presi-
dent, the point has merit, because now
higher education includes community col-
leges. I was not thinking so much of the
University of Maryland. Here you might
want a special community college located
in one location of the State. I think that
Delegate Maurer's suggestion would be
appropriate if it would meet Delegate Pen-
niman's approval.
DELEGATE JAMES (presiding): Dele-
gate Penniman.
DELEGATE PENNIMAN: I have no ob-
jection to it.
DELEGATE JAMES (presiding): Will
there be an amendment proposed to effect
this clarification ?

come when we get to the section or article
on education, and perhaps I could insert it
as I made the report.

Maybe I did not hear correctly, but on
page 9, section 3.22, line 29, when he
changed that to "enact," did you include
the word "either" in "either a congres-
sional redistricting or ....."?
DELEGATE PENNIMAN: I did not put
the word in.
DELEGATE BEACHLEY: It was in the
language down below.
DELEGATE PENNIMAN: I do not
think it is necessary, but I would not object
to it.
