2968 CONSTITUTIONAL CONVENTION OF MARYLAND [Dec. 30]

DELEGATE PENNIMAN: Correct. It is
simply an oversight.

THE PRESIDENT: So the words "by
law" should be there.

DELEGATE PENNIMAN: That is cor-
rect.

THE PRESIDENT: Would you offer an
amendment to that effect?

DELEGATE PENNIMAN: If I may do

so.

THE PRESIDENT: Amendment No. 12
would be to add the words "by law" and
after the word ".prescribe" on page 9, line
41. Is there any objection to considering
the amendment, notwithstanding the fact
it is not printed ?

The Chair hears no objection.
Is it seconded?

(Whereupon, the motion was duly sec-
onded.)

THE PRESIDENT: It has been duly sec-
onded to add the words "by law" after the
word "prescribe."

Is there any objection?

A vote Aye is a vote for the amendment,
and a vote No is a vote against.

Cast your vote.

Has every delegate voted? Does any
delegate desire to change his vote?

(There was no response.)
The Clerk will record the vote.

There being 95 votes in the affirmative
and 1 in the negative, the motion is carried
and the amendment is adopted.

DELEGATE BURDETTE: I must say
that I am not quite sure whether there is
still an opportunity for some more lan-
guage clean-up. If there is, my suggestion
is not an emergency, but in 4.24 in line 38,
to avoid a pure rhetorical problem and to
obtain clearly the meaning1 that Chairman
Morgan desires, we should place after the
"majority vote" the word "and."

THE PRESIDENT: In line 38?

DELEGATE BURDETTE: Yes. "The
Board shall act by majority vote 'and' ....."

THE PRESIDENT: Do you desire to
submit such an amendment?

DELEGATE BURDETTE: I do.

THE PRESIDENT: Is there any objec-
tion to considering the amendment sug-
gested by Delegate Burdette, to add the
word "and" before the word "shall" in line
38, notwithstanding the fact that it is not
printed? The Chair hears none.

This will be Amendment No. 13. Add the
word "and" after the comma and before
the word "shall" on line 38, page 9.

Is there a second?

(Whereupon, the amendment was duly
seconded.)

THE PRESIDENT: Is there any discus-
sion?

Are you ready for the question ?

The question arises on the adoption of
Amendment No. 13. A vote Aye is a vote
in favor of the amendment. A vote No is a
vote against.

Cast your vote.

Has every delegate voted ? Does any
delegate desire to change his vote?

The Clerk will record the vote.

There being 92 votes in the affirmative
and 2 in the negative, the motion is carried
and the amendment is adopted.

On page 10, section 4.26: Reorganization
of the Executive Branch, strike out all of
lines 30, 31, 32 and down to and including
the word "administration" in line 33, and
insert in lieu thereof the following: "of
offices, agencies, instrumentalities and prin-
