the representatives of the people should be
the accusing body and that the trial itself,
the tryer of the facts, should be judges
who perhaps by their temperament, by
their experience, by their expertise, might
be far removed from the political arena
and not under the political pressures of
the time and could perhaps more impar-
tially and with more judicial knowledge
try the situation.

THE CHAIRMAN: Delegate Malkus.

DELEGATE MALKUS: Mr. Chairman,
are you saying then that the proceedings
brought by the House of Delegates would
in no way be affected by politics?

THE CHAIRMAN: Delegate Boyer.

DELEGATE BOYER: I cannot say that,
sir. I could not say anything would or
would not be affected by politics.

THE CHAIRMAN: Delegate Malkus.

DELEGATE MALKUS: My third ques-
tion, Mr. Chairman, is are you not taking
some of the legislative power away by
these proceedings?

THE CHAIRMAN: Delegate Boyer.

DELEGATE BOYER: No, I cannot
agree that it is necessarily taking away
any legislative power. Some may look on it
as that, Senator, but our intent was that
if there ever should be any impeachment
proceeding, which is remote, but possible,
the accused should perhaps receive the most
unpolitical trial by people who were ex-
perienced.

THE CHAIRMAN: Delegate Malkus.

DELEGATE MALKUS: Mr. Chairman,
do you not think that the Maryland Senate
should have an equal voice in bringing
these charges?

THE CHAIRMAN: Delegate Boyer.

DELEGATE BOYER: The Committee
recommendation was that the charges
should be brought by the House of Dele-
gates and tried by the special tribunal.

THE CHAIRMAN: Delegate Malkus.

DELEGATE MALKUS: You are shoot-
ing again from the hip.

THE CHAIRMAN: Delegate Boyer.

DELEGATE BOYER: That is Commit-
tee Recommendation No. GP-10. How I
feel about it might be a different situation.
I am reporting to you the general recom-

mendations from the General Provisions
Committee.

THE CHAIRMAN: Delegate Malkus.

DELEGATE MALKUS: Now, Mr.
Chairman, how do you feel personally?

DELEGATE BOYER: As a loyal Com-
mittee Chairman, I am going along with
the Committee recommendation, sir.

THE CHAIRMAN: Delegate Malkus.

DELEGATE MALKUS: Mr. President,
can I make an observation?

THE CHAIRMAN: I suppose we can
accord you that privilege.

DELEGATE MALKUS: You know, sir,
I have been very quiet recently.

DELEGATE BOYER: Fantastic.

DELEGATE MALKUS: The back bench-
ers are giving me a hard time, but I would
like to say this. In the future when an
ambitious man from the House of Delegates
wants to get in the Senate seat across the
hall, he has got the door wide open for
him now.

THE CHAIRMAN: Are there any fur-
ther questions of the Committee Chairman?

Apparently there are no further ques-
tions.

If Delegate Boyer will return to his
seat, we will take up Committee Recom-
mendation GP-10.

While we are waiting for that, the Chair
recognizes Delegate Darby.

DELEGATE DARBY: Mr. Chairman
and fellow delegates, I would like to ask
the Committee to extend their usual warm
welcome to some relatives of mine, my
sister and brother-in-law, Mr. and Mrs.
Charles Brooks, and my nephew, Charles
Brooks, Jr., in the gallery facing the
President.

(Applause.)

THE CHAIRMAN: Delegate Hanson, do
you desire to offer your amendment C?

For what purpose does Delegate Scanlan
rise?

DELEGATE SCANLAN: I would like
the Assembly to extend its warm regards
to Miss Marie Carver and to Mr. Gerald
Goldberg of Montgomery County and a
member of the Town Council of the Town
of Somerset who are in the gallery op-
posite the President.

(Applause.)
