The Clerk will record the vote.
Mr. Vice President, do you want me to
vote for you?
DELEGATE J. CLARK: Yes.
DELEGATE JAMES (presiding): Has
every delegate voted? Does any delegate
desire to change his vote?
(There was no response.)
The Clerk will record the vote.
There being 71 votes in the affirmative
and 41 in the negative, the motion carries.
The amendment is adopted.
DELEGATE JAMES (presiding): Dele-
gate Clarke.
DELEGATE E. CLARKE: Personal
privilege, Mr. President.
DELEGATE JAMES (presiding): The
Chair recognizes Delegate Clarke.
DELEGATE E. CLARKE: Mr. Presi-
dent, as you know and perhaps many others
here know, though perhaps some do not, in
the near future a great portion of the
tourist and convention business that has
been going elsewhere will remain in the
State of Maryland. One of the principal
reasons for this is the great effort put
forth to build the Ocean City Auditorium.
The chief sponsor of this step forward in
the House of Delegates was and still is
the Honorable Russell Hickman of Wor-
cester County who is seated in the balcony
to the rear of the chamber. Please greet
him.
(Applause.)
DELEGATE JAMES (presiding): Are
there any further amendments to section
9? The Chair recognizes Delegate Carson.
DELEGATE CARSON: Mr. Chairman,
for the record, I unintentionally voted
wrong for the last one. I wanted to vote in
favor of the amendment, and somehow I
voted against it. We need not change the
record, I just would like the tape to show
that.
DELEGATE JAMES (presiding): I
think we are all entitled to one erroneous
vote and I have cast at least one, maybe
two.
Are there any further amendments to
section 9?
(There was no response.)
If not, we will pass on to section 10.

The Chair has on his desk an amend-
ment submitted by Delegates Bothe et al.
Has the amendment been distributed? It
is marked "F". Amendment F. Has that
been distributed? The pages will distribute
Amendment F. Does everyone have a copy
of Amendment F?
It is a very simple amendment. I will
ask the Clerk to read it. It just strikes
out the section.
(Laughter.)
READING CLERK: Amendment No. 16
to Committee Recommendation R&P-2 by
Delegates Bothe, Bennett, Bamberger,
Bradshaw, Byrnes, Dulaney, Gallagher,
Hanson, Henderson, Hopkins, Johnson,
Koss, Lord, Macdonald, Marion, Morgan,
Moser, Powers, Scanlan, Schneider, Sher-
bow and Winslow:
On page 3, section 10, Criminal Jury,
Judge of Law and Fact, strike out all of
lines 32 through 39, inclusive, comprising
all of section 10.
DELEGATE JAMES (presiding): The
Chair recognizes Delegate Bothe.
For what purpose does Delegate Moser
rise?
DELEGATE BOTHE: I yield to Dele-
gate Moser.
DELEGATE JAMES (presiding): Dele-
gate Moser has the floor to speak on the
amendment.
DELEGATE MOSER: Is there a quo-
rum ?
DELEGATE JAMES (presiding): You
want a quorum call. All right. The Clerk
will ring the quorum bell.
The members will record their presence
on a quorum call.
Has every delegate recorded his pres-
ence?
(There was no response.)
The Clerk will record the quorum call.
A quorum being present, the Chair recog-
nizes Delegate Moser to speak on the
amendment.
DELEGATE MOSER: Mr. Chairman
and ladies and gentlemen —
DELEGATE JAMES (presiding): We
will have to have a little order in here.
Even though we are members of the Con-
stitutional Convention, we should have
manners.
