2118 CONSTITUTIONAL CONVENTION OF MARYLAND [Dec. 9]

DELEGATE J. CLARK: Mr. Chair-
man —

THE CHAIRMAN: The tally shows you
are not voting. The Chair understands you
were voting Nay, but your switch is not
working.

DELEGATE J. CLARK: Of late my
switch usually stops at 5:00 P.M. It stopped
a little later today.

THE CHAIRMAN: Which way did you
vote, sir?

DELEGATE J. CLARK: Aye.
(Applause.)

THE CHAIRMAN : There being 60 votes
in the affirmative and 59 in the negative,
the motion carries. The amendment is
adopted.

DELEGATE JAMES: Sixty votes in
the affirmative and 59 in the negative.

THE CHAIRMAN: Are there any fur-
ther amendments to Committee Recom-
mendation EiB-2? The Chair hears none.

The question now rises on the adoption,
on the approval of Committee Recom-
mendation EB-2, as amended. Are you
ready for the question?

(Call for the question.)
The Clerk will ring the quorum bell.

The question arises on the approval of
Committee Recommendation EB-2.

A vote Aye is a vote in favor of the
approval of the recommendation as
amended. A vote No is a vote against.

READING CLERK: Delegate dark's
vote did not show again.

THE CHAIRMAN: Delegate Clark, will
you indicate your vote orally?

DELEGATE J. CLARK: Aye.

THE CHAIRMAN: There being 101
votes in the affirmative and 15 in the
negative, the motion carries. The Recom-
mendation is adopted.

We misinformed you by indicating that
the consideration of this amendment would
take one-half hour. We thank you very
much for your patient consideration and
able presentation.

The next item on the calendar for the
Committee of the Whole is the resumption
of Committee Recommendation R&P-1.

At the time of the recess on considera-
tion of this recommendation yesterday we
had concluded the presentation by the
Chairman of the Committee. We now enter
the period of questions to the Chairman of
the Committee. I will request Delegate
Kiefer to corne forward.

May the Chair take this opportunity to
remind you that the period of questioning
of the Committee Chairman is not a period
of debate, and engaging in extensive
colloquy with the Chairman of the Com-
mittee interferes with the presentation of
the report.

The purpose of the question period is to
make abundantly clear the meaning of
the report and the intent of the Committee
in presenting it.

Will you therefore please keep your
questions confined to that purpose?

Will you please also keep in mind that
when other delegates are seeking the floor
to ask questions you should reduce the
number of your questions as much as pos-
sible?

Are there any questions of the Commit-
tee Chairman with respect to Committee
Recommendation R&P-1 or the committee
recommendation in support thereof?

DELEGATE SYBERT: Mr. Chairman,
I noticed section 1 in the report is "Free-
dom of Expression." I wonder if this
would be the appropriate place to inaugu-
rate a gag rule while we are considering
this "Freedom of Expression," in order to
shorten debate.

THE CHAIRMAN: I am all for that,
Delegate Sybert.

Are there any other questions of the
Committee Chairman?

DELEGATE GRANT: Mr. Chairman, in
section 5 under "Rights of the Accused,"
the section says a person accused of a
crime shall so forth and so on, and my
question was, how broad an interpretation
the Committee intended to place on the
words "accused of a crime"?
