2090 CONSTITUTIONAL CONVENTION OF MARYLAND [Dec. 9]

A vote Aye is a vote in favor of Amend-
ment No. 1. A vote No is a vote against.

Delegate Hardwicke ?

DELEGATE HARDWICKE: Before we
take the vote, may I ask a question of
Delegate Morgan?

THE CHAIRMAN: Delegate Morgan, do
you yield to a question?

DELEGATE MORGAN: I yield.
THE CHAIRMAN: Delegate Hardwicke.

DELEGATE HARDWICKE: I realize
there is some impatience on the part of
some of the delegates, but I think this is
too important for impatience, Mr. Chair-
man.

Delegate Morgan, I understood you to
say in reply to questions asked of you that
these other matters which the General As-
sembly could give to the attorney general
ought to be legal in nature.

T1HE CHAIRMAN: Delegate Morgan.

DELEGATE MORGAN: That is correct,
that was the hope of the Committee.

TPIE CHAIRMAN: Delegate Hardwicke.

DELEGATE HARDWICKE: Then I take
it if this amendment of Delegate Gallagher
should fail, you would have no objection to
an amendment which would insert the word
"legal" before the word "matters".

THE CHAIRMAN: Delegate Morgan.
DELEGATE MORGAN: Where?

DELEGATE HARDWICKE: In line 7 on
page 2.

THE CHAIRMAN: Delegate Morgan?

DELEGATE MORGAN: I think I would
object, because I think what you are doing
by inserting the word "legal'' is just build-
ing the possibility of endless litigation as
to whether the attorney general should or
should not have been given this or that
particular power.

THE CHAIRMAN: Is there any further
question, Delegate Hardwicke?

DELEGATE HARDWICKE: Then I take
it that you mean by the unamended pro-
posal that the attorney general ought to
be confined to legal matters, but you are
not going to absolutely, constitutionally
require that?

THE CHAIRMAN: Delegate Morgan.

DELEGATE MORGAN: That is correct.

THE CHAIRMAN: The question arises
on the adoption of Amendment No. 1 to
Committee Recommendation EB-2.

A vote Aye is a vote in favor of the
Amendment No. 1. A vote No is a vote
against.

Cast your votes.

Have all the delegates voted ? Docs any
delegate desire to change his vote ?

(There was no response.)
The Clerk will record the vote.

There being 39 votes in the affirmative
and 86 in the negative, the motion is lost.
The amendment is rejected.

Delegate Gallagher, do you desire to
offer your amendment B?

DELEGATE GALLAGHER: I do, sir.

THE CHAIRMAN: The Pages will please
distribute amendment B. This will be
Amendment No. 2.

For what purpose does Delegate Sickles
rise ?

DELEGATE SICKLES: A point of per-
sonal privilege.

THE CHAIRMAN: State your privilege.

DELEGATE SICKLES: I know that this
Convention will want to extend its usual
warm greetings to the wife and son, Mar-
cella and Randy, of Delegate Ray Boileau.

THE CHAIRMAN: We are delighted to
have you.

(Applause.)
The Clerk will read the amendment.
Delegate Gilchrist.

DELEGATE GILCHRIST: A point of
personal privilege. I know that in view of
the fact that something has just happened
to Delegate Gallagher the Convention would
want to indicate their respect and affection
for his family who are seated in the gallery
at the rear.

(Applause.)

THE CHAIRMAN: I understand the
Pages have distributed the wrong amend-
ment. It should be Amendment B. Will you
please return Amendment D to the Pages
and they will give you amendment B. B for
Baker.
