1908 CONSTITUTIONAL CONVENTION OF MARYLAND [Dec. 6]

The Clerk will record the vote.

There being 52 votes in the affirmative
and 76 votes in the negative, the motion is
lost and the amendment to the amendment
is rejected.

The Chair recognizes Delegate Cardin.
Do you desire to submit your amendment?

DELEGATE CARDIN: Mr. Chairman,
my inexperience and ineptitude in this type
of body places me in a quandary. I would
like to introduce my amendment, but I
would not like to introduce it now. I
should like to explain, if I may. Perhaps
you can assist me.

THE CHAIRMAN: State your inquiry.

DELEGATE CARDIN: There are mem-
bers here who have stated that if twenty-
one were to fail, they would prefer to vote
for twenty. If we vote on this amendment
of twenty now, as I understand your ar-
rangements in the voting order, we will
preclude the opportunity of voting after-
wards.

Is that correct?

THE CHAIRMAN: You would, but you
would lose that opportunity anyhow if you
did not offer the amendment now, and if
Amendment No. 1 were adopted. If Amend-
ment No. 1 fails, you would then have the
opportunity to submit your amendment as
another amendment to the Committee Rec-
ommendation. In other words, you have
these choices open. If you offer your amend-
ment now as an amendment to Amend-
ment No. 1, it gives the Committee of the
Whole the opportunity to decide whether
Amendment No. 1 shall have in it the age
twenty-one or twenty. If your motion fails,
the Amendment No. 1 would then be sub-
mitted, and the Committee of the Whole
would decide on the age twenty-one versus
nineteen. If your amendment succeeds, then
Amendment No. 1 would be submitted, and
the Convention would decide on age twenty
versus age eighteen. If you do not submit
your amendment now, and Amendment No.
1 is submitted to the Committee of the
Whole and fails, the Committee Recom-
mendation is still open to amendment and
you could then submit your amendment to
vote on the age twenty versus nineteen.
If, however, you do not submit your amend-
ment now and Amendment No. 1 passes,
the Committee of the Whole has decided
that the age is twenty-one, and there would,
therefore, not be any opportunity to con-
sider it further.

If you want to submit to the Committee
of the Whole age twenty versus age twenty-
one, your opportunity is now.

DELEGATE CARDIN: I withdraw the
amendment.

THE CHAIRMAN: You have not offered
it so it is not withdrawn. It is available to
you later. The Chair understands there are
no other amendments in this category. The
question now arises on Amendment No. 1.
Amendment No. 1 has not been amended.
It, therefore, proposes to substitute for the
age nineteen in section 1 of Committee
Recommendation S&E-2 the age twenty-one.

A vote Aye is a vote in favor of the
Amendment, that is, in favor of age
twenty-one. A vote No is a vote against
the Amendment and leaves the Committee
Recommendation S&E-2 at age nineteen.

Are there any questions?
Delegate Malkus.

DELEGATE MALKUS: Mr. President,
I would, of course, like to go further than
you want to go as far as these nineteen-
year-olds are concerned. I want to give
them full privileges and full responsibili-
ties. I have the amendment here. I think
you indicated my amendment would be out
of order. All I am trying to say is this.
This minority —

THE CHAIRMAN: If you forward a
copy of your amendment to the Chair, and
offer it, the Chair will rule whether it is
in order or out of order.

DELEGATE MALKUS: Mr. President,
I know what your ruling will be, but I
will g%o through the motions just the same.

THE CHAIRMAN: Delegate Malkus, in
any event, this amendment would not be
germane to Amendment No. 1 which is
now before the Committee of the Whole.
If you offer it, the Chair rules it out of
order for that reason. If, after we have
acted on Amendment No. 1, you desire to
submit the amendment, I will rule it out
of order on the ground that it is not
germane to the subject matter of the sec-
tion. You could then appeal the ruling.

What is your wish, Delegate Malkus?

DELEGATE MALKUS: Mr. President,
I am not the smartest man in the world,
but I know when I am beat.

THE CHAIRMAN : I take it you are not
offering the amendment.

(Laughter.)

THE CHAIRMAN: The question arises
on Amendment No. 1. A vote Aye is a vote
in favor of the amendment, in favor of age
