and he might be a deputy director, but
there would have to be an individual over
him who would be appointed by the
governor.

There would be no change whatsoever in
the State of the merit system employee.

THE CHAIRMAN: Delegate Hickman.
DELEGATE HICKMAN: Thank you.
THE CHAIRMAN: Delegate Maurer.

DELEGATE MAURER: Mr. Chairman,
might I point out first that the question of
civil service would hold whether my amend-
ment were adopted or not. It was my in-
tention to state that a person would be
entitled to a similar position, similar pay,
et cetera, but not necessarily a position as
head of the department.

THE CHAIRMAN: I think Delegate
Hickman understands that you did not.

DELEGATE HICKMAN: Yes.

THE CHAIRMAN: Are you ready for
the question?

(Call for the question.)

The question arises on the adoption of
Amendment No. 16 to Committee Recom-
mendation EB-1.

A vote Aye is a vote in favor of Amend-
ment No. 16. A vote No is a vote against.
Cast your votes.

Have all delegates voted? Does any dele-
gate desire to change his vote?

(There was no response.)
The Clerk will record the vote.

There being 29 votes in the affirmative
and 90 in the negative, the motion is lost.
The amendment is rejected.

The next amendment is No. 17. I take it
the discussion of that could not be con-
cluded in a few minutes.

The Chair will therefore recognize Dele-
gate Powers.

DELEGATE POWERS: Mr. Chairman,
I move that the Committee of the Whole
rise and report that it has not concluded
consideration of Committee Recommenda-
tion EB-1.

THE CHAIRMAN: The motion is sec-
onded. All those in favor signify by saying
Aye; opposed, No. The Ayes have it. It is
so ordered.

(Whereupon, at 12:55 P.M., the Commit-
tee of the Whole rose, and the Convention
reconvened.

(The mace was replaced by the Sergeant-
at-Arms.)

THE PRESIDENT: The Convention will
now come to order.

On behalf of the Committee of the Whole,
the Chair reports that the Committee has
had under consideration Committee Recom-
mendation EB-1, that it still has it under
consideration, and the Committee asks leave
to sit again.

Are there any announcements before we
recess this afternoon?

Delegate Kiefer.

DELEGATE KIEFER: Vice-Chairman
Bruce Price arrived shortly after the
quorum was sounded this morning and had
to leave a few minutes ago to attend a
funeral. Could his presence be noted?

THE PRESIDENT: The Chair will note
that Delegate Price was present during
most of the session this morning.

Are there any other announcements?
Delegate Morgan.

DELEGATE MORGAN: The Commit-
tee on the Executive Branch will meet at
1:45 P.M. this afternoon in the Committee
room.

THE PRESIDENT: Are there any other
announcements by committee chairmen?

(There was no response.)

(There was no response.)

All delegates not present at the roll call
this morning will indicate their presence
at the supplemental roll call.
