1402 CONSTITUTIONAL CONVENTION OF MARYLAND [Nov. 29]

DELEGATE J. CLARK (presiding):
Delegate Bamberger.

DELEGATE BAMBERGER: Yes, sir.

DELEGATE J. CLARK (presiding):
The Chair recognizes Delegate Bothe.

DELEGATE BOTHE: Mr. Chairman, I
am advised that there are amendments
being proposed to detail the duties of the
attorney general and for that reason it
would seem inopportune to discuss this
particular amendment at this point.

With the consent of my co-sponsors,
which I believe I have, I will request that
it be withdrawn, with the right to re-intro-
duce it at such time as the attorney gen-
eral's position is ascertained by the Com-
mittee of the Whole.

DELEGATE J. CLARK (presiding):
If there is no objection the Chair agrees to
this.

Delegate Sherbow.

DELEGATE SHERBOW: Mr. Chair-
man, could I please get one question an-
swered by Delegate Bamberger before it is
withdrawn?

DELEGATE J. CLARK (presiding):
Delegate Sherbow, we will come back to
this and I think that would be the proper
time to ask the question.

Delegate Weidemeyer.

DELEGATE WEIDEMEYER: Mr.
President, I had two questions I wanted to
ask Delegate Bamberger.

DELEGATE J. CLARK (presiding):
I think they will have to wait until we
come back to it.

Are there any further amendments to
this section?

Delegate Morgan.

DELEGATE MORGAN: Mr. Chairman,
the Committee has two amendments of a
clarifying nature. I am sure they can be
handled by unanimous consent.

In line 31, section 4. 05, after "4 years
and", insert "shall serve", so it will read,
"the governor shall be elected by those
voters qualified to vote in state elections
for a term of four years and shall serve
until someone has qualified to succeed as
governor or to serve as acting governor. "

The other change is in line 43, after
"both houses", insert "of the General As-
sembly. "

DELEGATE J. CLARK (presiding):
Would you read both of those again, please,
sir?

DELEGATE MORGAN: The first one is
in line 31 after the words "4 years and, " —
no, after the words "4 years and", insert
"shall serve", so it will read "for a term
of 4 years and shall serve until someone
has qualified" and so forth.

The next one is in line 43, after the
words "both houses. " There should be in-
serted "of the General Assembly. "

DELEGATE SYBERT: Mr. Chairman.

DELEGATE J. CLARK (presiding):
Delegate Sybert.

DELEGATE SYBERT: Will the Chair-
man of the Committee yield to a question?

DELEGATE J. CLARK (presiding):
Will the gentleman yield, Mr. Morgan?

DELEGATE MORGAN: I yield.

DELEGATE J. CLARK (presiding):
Delegate Sybert.

DELEGATE SYBERT: Mr. Chairman,
would it not read better and be more con-
sonant with what they usually put in con-
stitutions and statutes to say in line 31,
or begin the line with "to serve"? In other
words, it would read, beginning line 31,
"to serve for a term of four years, and
until someone has qualified to succeed him. "

I think that is the usual way to do it,
and it covers both serving the four years
and any further time until a successor
qualified.

DELEGATE J. CLARK (presiding):
Delegate Morgan.

DELEGATE MORGAN: That would be
fine.

DELEGATE J. CLARK (presiding):
Chairman Morgan.

DELEGATE MORGAN: In lieu of the
change that was suggested by me in line
31, I ask unanimous consent that the line
begin with the words "to serve", so it would
read "the governor shall be elected by those
voters qualified to vote in state elections to
serve for a term of four years and until
someone qualified to succeed him", et cetera.

DELEGATE J. CLARK (presiding):
The second part of the amendment remains
the same?

DELEGATE MORGAN: Line 43, after
"both houses" insert the words "of the
General Assembly. "
