134 CONSTITUTIONAL CONVENTION OF MARYLAND [Sept 25]
wording in 70B [751* does not exactly ex-
press the meaning as put forth by the com-
mittee. The wording says that you shall be
docked or deducted $15.00 for each day of
unexcused absences from sessions of the
Convention, or from meetings of authorized
committees or subcommittees. It seems to
me it should read, "and," to carry the mean-
ing as put forth by the committee and I
would move to strike the word "or" after
Convention and committees and substitute
the word "and."
THE PRESIDENT: Delegate Schneider,
which line of Section 70B [75] ?
DELEGATE SCHNEIDER: This is line
3 and line 4.
THE PRESIDENT: Would you state it
again, in line 3 after what word?
DELEGATE SCHNEIDER: Excuse me,
line 4, after the word "Convention", and
after the word "committees", the last word
is "or", and the word after Convention is
"or". If you would say, "and", it would
take the meaning that if you miss all of
these, you are docked; if you make any one
of them, you will not be docked.
DELEGATE SCANLAN: Delegate
Schneide^, I agree that the word "and" or
the word "or" are words that carry with
the^ arnbicruity. I am not sure whether your
amendment would clarify it for me.
In any event, does not the last sentence
make perfectly clear what is stated, for the
purpose of this deduction. A delegate shall
not be considered to have incurred an un-
excused absence on any day that the dele-
gate is in attendance at any session of the
Convention or meeting of any authorized
committtee or subcommittee.
DELEGATE SCHNEIDER: I agree
that makes it clear. I do not see any reason
for having a line which I believe is long
just because the last line will clear it up.
THE PRESIDENT: Delegate Schneider,
the Chair is unclear. Are you moving the
amendment in both places; that is, in line
4 and also in line 8, or only in line 4?
DELEGATE SCHNEIDER: No, sir, only
in line 4, the two amendments to strike
"ors" and put "ands", better express the
meaning of the Committee as Mr. Scanlan
had expressed it.
THE CHAIRMAN: Only in line 4?

final number assigned to the rule in the
Rules of the Constitutional Convention of
Maryland.
DELEGATE SCHNEIDER: Yes, sir.
THE PRESIDENT: Delegate Grant?

THE PRESIDENT: Delegate Dukes
seconded.
DELEGATE GRANT: That is copied ex-
actly from the statutory language which
uses the word "or" instead of the word
"and."
THE PRESIDENT: Is there any further
discussion of the motion to amend? Are
you ready for the question?

The question arises on the motion to
amend, and the motion to adopt the rule by
amending Rule 70B [751, by changing the
word "or", the first word, "or", in the fourth
line, to "and". A vote Aye is a vote in favor
of adopting the amendment. Delegate
Schneider?
DELEGATE SCHNEIDER: Mr. Chair-
man, my amendment was to change the
"or", the sixth word, and "or", the last
word of the sentence, unless the Chair is
dividing the question.
THE PRESIDENT: No. You want to
change both words, "or".
DELEGATE SCHNEIDER: Yes, sir.
THE PRESIDENT: Let me restate the
motion then. The motion is to amend the
motion to adopt the rule by amending Rule
70B [75], by changing the word "or" where
it appears in two places in the fourth line,
to the word "and". Are you ready for the
question?
(Call for the question.)
All those in favor, signify by saying Aye;
contrary, No. The Noes have it. It is so
ordered.

principal motion, the motion to approve the
Committee Report and adopt the rule? Are

The question arises on the motion to ap-
prove the Third Report of the Committee
on Rules, Credentials and Convention
Budget and adopt chapter 9, consisting of
Rules 70A [74], 70B [75] and 70C [76],
retroactive, as of September 12, 1967.
