you will have submitted to you the recom-
mendation as amended.

If that motion to amend is lost, then
you will have submitted to you the recom-
mendation in the form presented by the
Committee.

In any event, there will be two votes.

The question now arises on the motion
to amend the Recommendation No. 2 con-
tained in Committee Report EB-1, to strike
the word "not" from line 18.

As thus amended, the recommendation
would be that the office of comptroller be
provided for in the constitution. A vote
Aye is a vote in favor of the amendment,
in other words, a vote in favor of provid-
ing for comptroller in the constitution. A
vote No is a vote against the amendment.

Cast your votes.

Has every delegate voted? Does any dele-
gate desire to change his vote?

(There was no response.)
The Clerk will record the vote.

There being 70 votes in the affirmative
and 68 in the negative, the motion is carried
and the recommendation is amended.

The question now arises on the adoption
of the Committee Recommendation as
amended. As amended the Recommendation
reads as follows: "The Committee recom-
mends that the office of comptroller be pro-
vided for in the Constitution."

A vote Aye is a vote in favor of that
recommendation as amended. A vote No is
a vote against the recommendation.

Cast your votes.

Has every delegate voted? Does any dele-
gate desire to change his vote?

(There was no response.)
The Clerk will record the vote.

There being 72 votes in the affirmative
and 66 in the negative, the motion is
carried. Recommendation No. 2 as amended
is approved.

The Chair recognizes Delegate Tawes.

DELEGATE TAWES: Mr. Chairman,
and fellow delegates, my attention has just
been called to the presence in the gallery
of two very distinguished citizens of my
county, the County of Somerset, in the per-
son of the Chief Judge of the First Ju-
dicial Circuit of Maryland, and Mrs. E.

McMaster Duer, and I should appreciate
it if the delegates would give them a warm
welcome to this Convention.

(Applause.)

THE CHAIRMAN: For what purpose
does Delegate Boileau rise?

DELEGATE BOILEAU: I have an in-
quiry of the Chair.

THE CHAIRMAN: State the inquiry.

DELEGATE BOILEAU: As I under-
stand the motion that we just passed it
would be possible to have an appointed
comptroller. The only requirement is that
the comptroller be mentioned in the con-
stitution. Am I correct?

THE CHAIRMAN: That is correct.
Delegate Storm.

DELEGATE STORM: A point of per-
sonal privilege, Mr. Chairman.

THE CHAIRMAN: State the privilege.

DELEGATE STORM: I would like to
invite the attention of the assembly to the
presence in the gallery behind the Chair
of Senator Smelser from Frederick County.
I would also like to record the fact that
before we started recognizing people in
the gallery, the President of the Maryland
Federation of Women's Clubs attended
fairly regularly. She is sick and unable to
come now, and probably will not get back
to the Convention before it adjourns.

So in recognizing Senator Smelser I
would also like to recall that my wife is
here.

THE CHAIRMAN: Delighted to have
them with us.

(Applause.)

THE CHAIRMAN: Before the Commit-
tee of the Whole rises, the Chair desires
to announce so that there will be no mis-
understanding that the next item for con-
sideration when the Committee of the
Whole resumes will be Recommendation No.
3, dealing with the treasurer. After that is
disposed of we then revert to Recommen-
dation No. 1, then to Recommendation No.
4 and Recommendation No. 5.

DELEGATE SHERBOW: Mr. Chair-
man, I would like to make this inquiry of
the Chairman: In the light of the compro-
mise dealing with the Board of Public
Works and a person to be appointed by
