if this is true because' of a state constitution. I know
of innumerable situations in which welfare legislation,
if you want to call it that, was discovered to be
unconstitutional, and this goes back to the days between
Dred Scott and Jones and Laughlin.

What I am trying to say is I don't believe, or is it
true that the General Assembly does not have a blank check
to write legislation dealing with the rights of employees
to organize?
DELEGATE BOTHE: I understand the point you are
making and that is there could possibly be a barrier to
legislation being enacted without Constitutional authori-
zation.
One of the arguments in favor of placing this
provision in the Constitution would certainly be that
it woulfl place beyond any possible doubt the authority
of the General Assembly to pass this kind of legislation.
