mandatory effect upon the General Assembly. It does
not give nor detract fr.om the powers of the General
Assembly to enact legislation in this area.
In the past it has provided a Consumer Protection
Bureau, which is a division of the Attorney General's
office. That division is functioning and the committee
heard testimony from the Chief of that Division.
In certain instances the legislature has acted
in this area and much, much needs to be done,. Out to say
that this provision will guarantee that we will have
super protection, super education against harmful and
unfair business practices simply is not the contitutional
guarantee that it purports to be.
In the case of 2 Md 341, Watkins v. Watkins,
Annotation to Article VIII to the present Declaration
of Rights, it was held, the Judiciary may not compel
action on the part of a coordinate branch.
To say that our Court of Appeals or any court
o f this state would compel the General Assembly to enact
legislation in this area is simply misleading those who
would put their faith and trust in this provision. |
