My question i hy yott prohibited the possibllity
of the legislature conferring original jurisdiction
on the court of appeals but gave that powerto the
legislature with respect to the intermediate court.
It tBuggesti to we when an occasion arises
where the legislature did want to create original juris-
diction in an appellate court, that you have really
restricted them to fixing that in the intermediate appellat
court because enviously that is nuch easier to do than
amending the constitution and fixing it in the court of
appeals, kind of prejudged or at least reduced their
option.

Bimberger, and after hearing from several judges of the
court of appeals and intermediate court of appeals
and debating the matter within committee, our objective
was to maintain and perpetuate our court of appeals
as the court of last resort and with that appellate
jurisdiction responsibility not to be interfered with by
delegation cf original jurisdiction by the legislature,
and with the intermediate court of appeals absorbing |
