Let me point out that in sections 12, 13, and

for around 20 or 30 pages of the existing code, there is

ample provision made for the amendment to existing municipal

5

charters. For example, section 12 of article 23(a) provides:

an amendment of a municipal charter may be initiated by

7

the legislative body of a municipal corporation, or by

8

petition of qualified voters of a municipal corporation.

9

Then the code goes on to spell out at great

10

length the procedure. This is absolutely unnecessary. It

11

is completely inconsistent with what we have done here this

12

evening, and I urge you to defeat this amendment.

THE CHAIRMAN: Delegate Barrick.

DELEGATE BARRICK: Mr. Chairman, it seems to

15

me that Delegate Hardwicke has missed the point. It is

16

true that it is in 23(a), but that is only the procedure

17

and the authority is in 11(3).

Now, I think the Transitory Committee did a

19

wonderful job, but it was very clear in the draft that was

20

submitted for the schedule of legislation of local

21

government that the municipalities would have the power to
