"Misconduct in office: includes willful malfeas-

ance, misfeasance, nonfeasance, and any act involving moral

turpitude or contrary to justice, honesty, principles or

5

good morals, if performed by virtue of or under the

6

authority of the office."

"Incompetency is any physical, moral or intellec-

8

tual quality which incapacitates an officer to perform his

9

duties. The incompetency must be one which has arisen

10

since and did not exist prior to the election of the officer

11

sought to be removed."

So if a particular parson was elected and he

13

had those defects when he was elected, it is assumed that

14

the people had full knowledge of those defects, and they

15

are willing to be governed by the person as such. They

16

elected him.

Now, my amendment deals in very broad terms.

First of all, it gives to the General Assembly the power

19

which the people have got to give to somebody to set up

20

a system for the removal of officers. It provides for

21

an investigation, it d oes not say how this investigation
