DELEGATE HOPKINS: The word "record". Would

this be interpreted to apply to academic records of students

3

in the State colleges and public school system?

4

DELEGATE WILLONER: I will read you what the law

5

in Maryland is now: "The right to inspect public records

6

or certain classes of records kept by a public official as a

7

necessary part of his duty, has been held a right guaranteed

8

by common law. The common-law principle being that any

9

public record was open to an unqualified inspection.

10

Mandamus is considered to be an appropriate course of action

11

to enforce the production of public records for inspection

12

and private persons may avail themselves of this power with-

13

out the need for intervention by a government law officer.

14

The question of an individual's right to

15

inspect a record depends upon two basic requirements: First,

16

the individual must have sufficient interest in the records

17

or information and, second, that the records not be of such

18

a nature that the record not violate the law or public

19

policy."

20

It is my opinion that it would violate a public

21

policy to open up academic records. I
