wood of Balt. city, Ware, Fiery, Neill, John Newcomer, Harbine,
Michael Newcomer, Davis, eber and Slicer——32.

NEGATIVE—Messrs. Blakistone, Hopewell. Ricaud, Mitchell,
Dotsey, W ells, W eems, Bond, Merrick, Buchanan, Welch, Lloyd,
Colston, Constable, C hambers of Cecil, Bowie, Grason, W right,
Thontus, Sappington, Mc Henry, Gwinn, Brent, of Balt, city,
Presstman, Kilgour and Hollyday---26.
So the amendment was adopted.
Mr. Phelps, moved further to amend said report, by inserting
as the 38th section hereof, the following:
"Section 38th. No lottery grant shall ever heieafter be authorised
by the Legislature of this thate."
Determined in the affirmative.
Mr. Phelps, moved further to amend said report, by inserting
as the 39th section of said report, the following
"Sec. 39th. All properly both real and personal of the wife,
owned or claimed by her before marriage, and that acquired by
gift, devise or descent, shall be her separate properly, and laws
shall be passed by the Legislature, mote clearly defining the
rights of the wife in ielation to her separate ptoperty;"
Mr. Harbine, moved to amend said amendment by striking out
in the 2nd line, the words, ‘‘or
Mr. Phelps, accepted this amendment.
The said amendment was then adopted as amended.
Mr. Dorsey, moved to reconsider the vote of the Convention
just taken on this amendment;
Determined in the affirmative.
Mr. Crisfield, moved as a substitute for said amendment the
follow in g:
"The General Assembly shall pass laws necessary to protect
the property of the wife from the debts of the husband during her
life, and for securing the same to her issue after her death."
Which amendment Mr. Phelps accepted.
The said amendment was then adopted as the 39th section in
said report.
Mr. Gwinn moved further to amend said report by adding at
the end thereof as an additional section the following:
"The Mayor and city Council of Baltimore, shall have the ex
clusive right to open and close all streets, lanes and alleys within
the limits of the said city; but nothing in this section shall be Con
strued to prevent the Legislature from passing any general law
directing the process which shall be had in such cases, or from
