CHAPTER 88.
AN ACT to add a new section to Article 16 of the Code of
Public Local Laws, title "Montgomery County," sub-title
"Roads," to follow Section one hundred and seventy-six
and to be designated as Section 176 A.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and the same is hereby added to
Article 16 of the Code of Public Local Laws, title "Mont-
gomery County," sub-title, "Roads," to follow Section one
hundred and seventy-six, to be designated as Section 176A,
and to read as follows:

Roads.
Montgomery
County.

176A. No right of way, special privilege of travel on public
highways and roads or franchises or permission to lay railroad
bed and track shall be granted by the County Commissioners
of Montgomery County, or by the municipal authority of any
incorporated town in said county on any of the public high-
ways and roads in said county, or incorporated towns of said
county, to any electric, steam or other motive power company
unless such highway or road shall be at least thirty feet wide,
and in incorporated towns thirty feet wide, exclusive of side-
walks; provided, however, this Act shall not apply to or pre-
vent the crossing of such railroad from one side of such high-
ways and roads to the other side; provided that the provisions
of this Act shall not apply to Tacoma Park.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 89.

AN ACT to amend the charter of the Rising Sun, North East
and Elk River Electric Railway and Power Company, as
incorporated by the Act of the General Assembly of Mary-
land, January Session of eighteen hundred and ninety-eight,
Chapter two hundred and eighty -four.

When unlaw-
ful to lay

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Andrew Anderson, George W. Cosden, Joseph T.
Reed, Levi O. Cameron, John M. C. Carhart, William L.
Mearns, Ellis Duyckinck, Frank Machie, Mount E. Kirk and
James Mallen, all of Cecil County, Maryland, and their suc-
cessors in office, are hereby created a body corporate under

North East
and Elk River
Electric Ry
