ways and underground conduits laid under the authority of
this Act, in Baltimore City, shall be laid and constructed with
the consent and permission of the Mayor and City Council of
Baltimore, and under such conditions and regulations as the
Mayor and City Council may prescribe; and provided further,
that the said company may acquire for its use, by rental, lease
or otherwise, any conduit or conduits, ducts or sub-ways, now
laid, or that may hereafter be laid, in Baltimore City, by or
under the authority of the Mayor and City Council of Balti-
more, or now or hereafter controlled or owned by the Mayor
and City Council of Baltimore, upon such terms as may be
prescribed by the Mayor and City Council of Baltimore, or
otherwise; provided, however, that said corporation shall in
all respects be subject to the provisions of Chapter one hun-
hred and twenty-three of the Acts of the General Assembly
of eighteen hundred and ninety-eight, and all ordinances
passed by the Mayor and City Council of Baltimore in con-
formity therewith, and shall be subject to the control, in
every respect, of the Mayor and City Council of Baltimore,
in so far as its operation may be carried on in the City of
Baltimore, and nothing herein contained shall be construed
to the contrary; provided further, that before using the public
or county roads the assent of such use by the Board of County
Commissioners must be first had and obtained; and provided
further, that before using any of the lanes, alleys and streets
of any incorporated town or municipality, the assent of the
authorities of said town or municipality must be first had and
obtained.

SEC. 5. And be it enacted, That the said company shall have
and enjoy all the general powers, provisions, rights and privi-
leges, and be subject to the general regulations contained in
Article 23 of the Code of Public General Laws of Maryland,
and the supplements and amendments thereto; the said Article
being the Article providing for the formation, powers, regula-
tions of corporations, so far as the same may not be incon-
sistent or in conflict with the special or general regulations
or provisions, powers, rights and advantages conferred or
intended to be conferred by this Act; and that said corpora-
tion shall especially have the power to acquire land or rights
and easements therein or thereon, by purchase or by condem-
nation, under the regulations and provisions set forth in said
Article 23 of the Code of Public General Laws, and the
amendments or supplements thereto.

SEC. 6. And be it enacted, That the said corporation shall
have the power to borrow money, in such sums as may be
necessary or proper, to enable it to carry out its corporate
