XVII.
Commissioners
appointed, &c.
Damages to be
ascertained, &c.
Not to go thro'
buildings, &c. |
II. BE IT ENACTED, by the General Assembly
of Maryland, That George Ellicott, William Hammond
and Abraham Jessop, or any two of them, be and they are hereby appointed
commissioners to
survey, lay out and open, at the expence of the said Christopher Walker,
a road not exceeding thirty-three
feet wide, in such direction as the situation of the ground will admit,
and best answer the
purposes of this act, from Christopher Walker's mill, in Anne-Arundel county,
until it intersects
the Frederick turnpike road at or near the said seven mile stone; and the
said road, when so surveyed,
laid out and opened, and the valuation herein after directed to be made
shall have taken place,
shall be recorded in Baltimore county court, and shall be deemed and taken
to be a public road for
ever thereafter, and kept up, amended and repaired, as all other public
roads in the said county.
III. AND BE IT ENACTED, That the said commissioners
shall ascertain and value what damages
may be sustained by any person or persons through whose land the said road
shall pass, and the same,
when so assessed, shall be paid, or secured to be paid, by the said petitioner,
before the said commissioners
shall proceed to open the said road; provided always, that if any person
or persons through
whose land the said road shall pass, or his, her or their guardian or trustee,
shall conceive themselves
aggrieved by such valuation and assessment of damage by the said commissioners,
it shall and
may be lawful for the said commissioners, or any two of them, to issue
their warrant to any constable
of Baltimore county, to summon five freeholders of the county, not interested
in the premises,
and qualified to serve as jurors in the county court, to appear, on a day
by them to be appointed, on
the premises; and the said commissioners are hereby authorised to administer
an oath to every person
so summoned, that he will, without favour, affection, prejudice or
partiality, assess the damages
sustained by the person at whose request such inquisition shall be taken,
by reason of opening the
aforesaid road through his, her or their lands; and the persons so summoned
and sworn shall thereupon
proceed to assess and value the damages accordingly, of which the said
petitioner shall have
had at least five days previous notice; and such inquisition shall be final
and conclusive between the
parties.
IV. AND BE IT ENACTED, That the said commissioners
shall not lay out or open the said road
through the buildings, gardens or orchards, of any person, without his
or her consent. |

Preamble.

collect, &c.
Proviso. |
An ACT authorising Cornelius Howard Gist, late collector of Baltimore
county, to complete his collections.
WHEREAS Cornelius Howard Gist, late collector of Baltimore county,
hath set forth by his
petition to this general assembly, that there is still due to him, as collector
for the last year,
a considerable sum of money, which he has been unable to collect, owing
to the yellow fever that
has prevailed in the city of Baltimore, and prays that a longer time may
be allowed him to complete
the collection of the same;
II. BE IT ENACTED, by the General Assembly
of Maryland, That the said Cornelius Howard Gist be
and he is hereby authorised to collect all balances due him, as collector
for the last year, at any time
before the first day of October next, in the same manner as he could or
might have done whilst he
was collector, any law to the contrary notwithstanding.
III. PROVIDED ALWAYS, AND BE IT ENACTED, That
the said Cornelius Howard Gist, before he
proceeds to execute or distrain the property of any person or persons for
officers fees or taxes, shall,
at least ten days before such execution or distress, deliver to the person
chargeable with the same an
account, written in words at full length, of the taxes demanded of him,
her or them, with an affidavit
annexed to the same, that he hath not, to the best of his knowledge, received
any part thereof,
nor any thing in security or satisfaction for the same, more than the credits
given; and provided
also, that the said Cornelius Howard Gist, before he derives any benefit
from or under this act, shall
lodge his collector's books in the clerk's office of Baltimore county court,
to be there open to the inspection
of all persons interested in the same. |

An ACT to relinquish the right of this state to the tract of land
therein mentioned.
WHEREAS it appears to this general assembly, that a tract of land called
Bear Range, lying
to the westward of Fort Cumberland, was surveyed for and in the name of
