1800.
CHAP. LXI.
An ACT to authorise the laying out a public road from the ford on
    the Little Falls of Gunpowder, near a mill known by the name of
    the Dutch Mill, to intersect the York road near Josiah Hitchcock's
    old blacksmith's shop, in Harford county.

WHEREAS a public road, leading from the ford on the Little Falls of Gunpowder, near a mill
known by the name of the Dutch Mill, to intersect the York road near Josiah Hitchcock's old
blacksmith's shop, will be a great public convenience, and is essentially necessary; therefore,

    II.  BE IT ENACTED, by the General Assembly of Maryland, That Jacob Rutledge, Izard Hope and
Josiah Carter, or any two of them, be and they are hereby appointed commissioners to lay out a public
road, beginning at a ford on the Little Falls of Gunpowder, near the mill known by the name
of the Dutch Mill, and to run in a direction so as to intersect the York road near Josiah Hitchcock's
blacksmith's shop; and in laying out the said road, the said commissioners are directed to take into
view as well the disadvantages which may result to individuals over whose land the said road may
run, as the convenience of the public, so as to lay out the said road with as little injury to private
property as will comport with the public convenience.

    III.  AND BE IT ENACTED, That the said commissioners, or any two of them, be and are hereby
further directed to return a plot of said road, so by them laid out, to the clerk's office of said county,
to be there recorded; and the levy court may, at their discretion, after the return of said plot
as aforesaid, appoint a supervisor or supervisors to open the same, and shall levy a sum of money,
not exceeding one hundred and fifty dollars, for that purpose; and the said road, when opened as
aforesaid, shall be taken for, and is hereby declared to be, a public road in said county, and may be
repaired as other public roads are repaired in said county; provided nevertheless, that nothing herein
contained shall authorise the said commissioners to open the said road, or the levy court to levy
any sum of money for that purpose, until the assent of every person through whose land the said
road may pass be first had and obtained, under the hand of every such person, and returned to the
levy court aforesaid; and provided also, that nothing herein contained shall in any manner authorise
the said commissioners to lay out the said road through the lands of any infant, or person non compos
mentis
.

    IV.  AND BE IT ENACTED, That the commissioners appointed in virtue of this act shall be entitled
to an allowance of two dollars for every day they shall severally attend in discharge of the duties
herein imposed.

CHAP. LXII.
An ACT to appoint an agent for the year one thousand eight hundred
                                                        and one.

BE IT ENACTED, by the General Assembly of Maryland, That Henry Hall Harwood be agent of this
state, to execute the trust and power reposed in him by virtue of his act from the first day of
January, one thousand eight hundred and one, until the first day of January, one thousand eight
hundred and two.

    II.  AND BE IT ENACTED, That the said agent superintended the collection of all arrearages and
balances due from the several collectors of the respective counties within this state, and the said
agent is hereby authorised and required to call upon the treasurers of the respective shores for an
accurate statement of all arrearages and balances due from such collectors, and such account shall
be furnished by the said treasurers accordingly.

    III.  AND BE IT ENACTED, That the said agent be authorised to superintend the collection of
balances due to the state on the auditor's books or on open account; and the said agent shall have
power to require payment of, and, if necessary, to sue for and recover the same; and the said agent,
with the approbation of the governor and council, may make composition with any such debtors,
and take bonds to the state, with sufficient security, and give time for payment, not exceeding two
years from the first day of January, one thousand eight hundred and one.
