14            VOTES and PROCEEDINGS, November Session, 1800.

    THE committee to whom was referred the petition of David Kerr, of Talbot county, report, that they have
taken the same into consideration, and are of opinion that the prayer of the petitioner ought to be granted; they
therefore beg leave to recommend the following resolution, viz.
    RESOLVED, That the treasurer of the western shore be and he is hereby authorised to pay unto David Kerr,
of Talbot county, the sum of five pounds three shillings and eight-pence halfpenny, the amount of improvements
returned in a certificate of survey made for said Kerr on a tract of land called Glassenton, in Talbot county,
and by him paid into the treasury.

Which was read.
    The report on the petition of Christian Musselman was read the second time, concurred with, and leave given
to bering in a bill pursuant thereto.  ORDERED, That the committee appointed on said petition prepare and bring
in the same.
    The report on the petition of William Cahall was read the second time, concurred with, and leave given to
bring in a bill pursuant thereto.  ORDERED, That the committee appointed on said petition prepare and bring
in the same.
    Mr. Montgomery, from the committee, delivers to the speaker the following report:
    THE committee to whom was referred the petition of the justices of the orphans court of Harford county
report, that they have taken the same under their consideration, and find that the facts therein stated are true,
and are of opinion that leave ought to be given to bring in a bill to remedy and aid the defects in the register's
office according to the prayer of said petition.
                                                    By order,                                                        L.  GASSAWAY, clk.
Which was read.
    The clerk of the senate delivers the following message:

BY the SENATE, November 10, 1800.
        GENTLEMEN,
    WE have received your message, and are ready to proceed to the election of a governor as proposed by you.
WE have appointed Charles Goldsborough, junior, and William Hemsley, junior, Esquires, to join the gentlemen
named by you in the examination of the ballots.  No person is nominated by this house in addition to the
gentlemen named by you in the examination of the ballots.  No person is nominated by the house in addition to the
gentlemen named by you.
                                                    By order,                                                        W. S.  GREEN, clk.
    Which was read.
And a letter from John Callahan, register of the land-office, with an account of taxes receive in said office for
one year, endorsed; " By the senate, November 10, 1800:  Read and referred to the consideration of the house
" of delegates.
                                                    " By order,                                                      W. S.  GREEN, clk."
   Which was read, and referred to Mr. McPherson, Mr. McCulloch and Mr. Chapman, to consider and report
thereon.
   The house having qualified agreeably to the constitution and form of government, proceeded to the choice of a
governor, and the ballots being deposited in the ballot box, the gentlemen names to strike retired, and after some
time returned and reported, that the honourable Benjamin Ogle was unanimously elected.
    Whereupon RESOLVED, That the honourable Benjamin Ogle be, and is hereby declared to be, governor of
the state of Maryland.
    The report on the petition of the judges of the orphans court of Harford county was read the second time,
concurred with, and leave given to bring in a bill pursuant thereto.  ORDERED, That the committee appointed
on said petition prepare and bring in the same.
    Mr. Orrell, from the committee, delivers to the speaker a bill, entitled, An act to authorise and empower the
levy court of Caroline county to assess and levy a sum of money for the support of Solomon Cahall, Sarah Cahall,
Mary Cahall and Amey Cahall; which was read the first and second time by especial order, passed, and sent to
the senate by the clerk.
    The clerk of the senate delivers the following message:
BY the SENATE, November 10, 1800.
        GENTLEMEN,
    THE joint committee of both houses having reported that the honourable Benjamin Ogle is unanimously elected
governor, we think proper to notify the same to him, and request his attendance in the senate room to qualify
agreeably to law, and have appointed James Hollyday and William Hindman, Esquires, to join any members of
your house for that purpose.
                                                    By order,                                                            W. S.  GREEN, clk.
Which was read.
    The following message being prepared, was sent to the senate by the clerk.
