Assume and promise to pay to him the said William the
summe of Two Thousand Six hundred and seaventy pounds of
good tobacco & Caske the which said summe well and truly to
pay he bindes himselfe his heires executors: & admrs: to the
said William his heires executors at place & time in the
said bill specified the which said bill is by the plaintiffe
here produced in Cort: as recourse thereunto being had more at
plaine will appeare but the said Henry fraudulently
intending him the said William to deceive of the sd: summe
aforesaid refuseth payment The plaintiffe saith he is Dam
nified to the vallue of Two Thousand nine hundred ninety
nine pounds of Tobacco and Caske and thereupon bringeth
his Suite ; / ; pro quer Tho: Poole
This bill bindeth me Henry Smith of the County of
Sommersett in Maryland my heires executors admrs:
to pay to William Tompson of Nansemond in Virga:
his heires executors: admrs: or assignes the summe of
Two Thousand Six hundred & seaventy pounds of
good tobacco and Caske due to be paid Conveniently
in Manoakin river upon demand for the performance
of which I have hereunto Subscribed my hand & Seale
this 29th: day of Sept: Annoq Domini 1674 ~ ~ ~
