Thomas Lappleyard plt: Henry Smith pro plt:

John Proute Deft: Wm: Tompson pro deft:
Sommersett Ss: John Proute was attached to answer the
sute of Thomas Lappleyard in an accon
of Trespas upon the Case ; / ;
And the said Thomas by his Attorney Henry Smith
saith That in the fall last past he left in the house and
Custody of William Willkison neare upon A hhd: of Corne
in eares Containing about fourteene busshells but the
said John marrying of the widowe of the said William
hath without the Consent of the sd: Thomas made use of
& Converted the sd: Corne unto his owne use & refuseth
to make satisfaccon for the sd: Corne allthough severall
times hath bin thereunto Demanded whereby the
sd: Thomas is Damnified & hath Dammadge to the
vallue of one Thousand pounds of Tobacco & Caske
& thereupon brings his Suite ; / ;
And the aforesd: John by Wm: Tompson his Attorney
