of the Dominion of the Rt: honr:ble Caecilius &c Annoq Domini 1674
before his Lopps: Justices thereunto Assigned & Authorised

Sommersett Ss John Avery Late of this County was
summoned to Answer unto Randall Revell
in an accon of the Case &c
And whereupon the said Randall by mr: Henry Smith
his Attourney saith that he the said John Avery became
Indebted unto him the said Randall Revell in the Just
summe and quantity of one Thousand five hundred
and forty pounds of Tobacco and Caske as pr Accompt here
produced in Cort: Doth appeare the said John having paid
eight hundred pounds of Tobacco and no more of the said
1540 pounds of tobacco The said John Denying and Still
doth to pay the ballance of the Accompt which is the
full summe of seaven hundred and forty pounds of tobacco
and Caske the plt: saith he is Damnified and hath Damage
to the vallue of 1400 pounds of Tobacco And thereupon
bringes his suite &c ; / ; ~ ~ ~ ~ ~ ~
And the plt: by his Attorney Henry Smith further saith yt:
The writt was Served upon the Deft: John Avery he the
said John not appearing by himselfe nor Lawfull Attorney
