promise Little regarding but fraudulently intending the said
Browne in this behalfe to Deceive in the summe of Three
hundred & forty pounds of tobacco whereupon the plaintiffe
saith he is Damnified and hath Losse the vallue of six hundred
pounds of Tobacco and hereupon brings his suite &c.

These Presents wittnesseth that I Thomas Ball of Wiccocomoco
in the County of Sommersett in the Province of Maryland plantor
Doe owe and Stand Justly Indebted unto David Browne of Manokin
of the said County the full and Just summe of Three hundred
and forty pounds of good sound tobacco wth. Caske (for & in Consideracon
of A bill of Tymothy Loue payable from the said Loue to the said
Browne for the sume aforesaid) to be paid Convenient In Wicco
comoco upon Demand in wittnes whereof I have hereunto
Sett my hand this 13th: of March 1673/4 ~ ~ ~ ~ ~

Came in his proper person before the Cort: And then and there in open
Cort: Did Acknowledge his hand & Seale to the said writing wherein
he was bound to pay unto y Plt: David Browne the Just quantity of
Three hundred & fforty pounds of tobacco in Caske; And thereupon
this Cort: orders That the sd: Thomas Ball pay unto David Browne
or his ordr: Three hundred & forty pounds of Tobacco in Caske
with Cost of Suite Alias execucon; Memorandum Capta: Wm: Coleborn
Ingaged to pay the same for the use of Tho: Ball to David Browne
