The Same Day, Commrs: as afore
Thomas Moollson plt:

John Avery deft:
Sommersett Ss John Avery Late of Somr:Sett County
was summoned to answer unto Thomas
Moollson in an Accon of y Case &c
And whereupon the said Tho: Moollson for himselfe saith
That About Two yeares & A halfe Since John Avery did
borrow of the plt: rightes for one hundred Acres of Land
And Did Assume upon himselfe & promise That he woulld
within one yeare next after the plaintiffe had Assigned the
rights over to him restore him Rights againe to y quantity
of one hundred Acres of Land or otherwise make him satisfaccon
But he the Sd: John Avery Little Regarding his promise &
Assumpcon But fraudulently intending to deceive him ye
said Thomas of the said Rights for one hundred Acres
of Land which hath been often demanded but hath denyed
& Still doth to make any satisfaccon for the same whereupon
the plt: saith he is Damnified And hath Dammadge to ye vallue
of ffoure hundred pounds of tobacco & thereupon brings his
Sute, &c ~ ~ ~ ~ ~ ~ ~
The Deft: appeares & ownes that he did borrow
Two rights of y plt: whereupon ye Cort: ordrs: that ye
deft: John Avery pay unto The plaintiffe Thomas
