85 The Same Day Commrs as afore

James Davis deft: of Debt they both appeare before the board

James Davies late of Sommersett County was Attached
to answer unto Randall Revell in a plea of Debt &c
And whereupon the said Randall Revell for himselfe saith
That he the said James Davies did upon the thirtieth day of
Aprill in the XXXiXth: year of the Dominion of Caecilius &c
Ao: Do: 1670 by a Certaine Speciallty Signed with the hand & Sealed
with the Seale of him the said Davies which is produced by
the plaintiffe here in Court. Assume upon himselfe & promise
that he the said Davies woulld pay or Cause to be paid unto
mr: Randall Revell of the said County & Province aforesaid
his heires executors: administrators: or assignes the full &
Just quantity of one thousand Six hundred pounds of good
Sound marchantable tobacco wth: Caske (being for A valuable -
Consideracon by him the said Davies received to be paid to y
said Randall Revell or his aforesaid ordr upon demand att or
before the tenth day of october next ensueing the Date of the
Said bill att Some Convenient place in the said County To
the performance of which he binds himselfe his heires executrs:
And administrators: but he the said Davies Little regarding
his promise, but fraudulently intending to deceive him the
Said Revell of the aforesaid quantity of one thousand Six
hundred pounds of good sound marchantable tobacco wth: Caske
which being often demanded but hee the said Davies
denieing & Still doth to pay; The plaintiff sayes he is
Dampnified
